MHADA Lottery Scheme 2020

MHADA, established in 1948, is a housing scheme released by the Housing and Area Development Authority, Government of Maharashtra for the people of the state. Desired applicants can apply for the scheme under four categories economically weaker section, lower-income group (LIG), Middle-income group (MIG) and High-income group (HIG) category. What are the objectives of MHADA Lottery 2020?

The main purpose of this MHADA housing scheme 2020 is to give housing to economically backward, poor people at affordable rates. MHADA Lottery 2020 Refund Policy

For unsuccessful applicants, the authority will initiate the refund process within 7 working days of the draw date. Applicability of GST on Real Estate: Under-Construction & Completed Property

GST in India:

The GST journey began in India in the year 2000 when a committee was established to draft law. It took almost 17 years from then to implement GST in the country. The GST bill was passed in the Lok Sabha and Rajya Sabha in the year 2017. On 1st July 2017, the GST law comes into force across the country.

The Goods and Services Tax (GST) Council in the 34th meeting has reduced the GST rate on 19th March 2019 on under-construction houses. For flats rated more than Rs 45 lakh, the new GST rate applicable from April 1, 2019, stands at 5%, against 12% currently.

The GST Council also reduced GST rates on affordable housing to 1%, from the current 8%. In both cases, the builders will not be eligible to claim an input tax credit in the new structure.

This move will give a fillip to apartments under construction in the country, and improve the flow of credit to the real estate sector.

The GST Council practiced a double definition for “Affordable Housing”, based on carpet area and cost. In metro cities, the affordable houses will be defined as a house with a carpet area of up to 60 sq.m. and rated less than Rs 45 lakh. In non-metros, a bigger flat of up to 90 sq.m. would be considered affordable housing, with the price bracket unchanged at Rs 45 lakh.

Why did India Adopt the system of Goods & Service Tax (GST)?

The main objective of uniting the GST was to reduce the tax on tax or double taxation, which cascades from the manufacturing level to the consumption level. Apart from that, with the increase of international trade in services, GST has become a global standard.

In simple terms, GST is an indirect tax charged on the supply of goods and services. This rule has replaced many indirect tax laws that earlier existed in India. This tax will be a replacement for all indirect tax levied by state and central government. Exports and direct tax such as income tax, corporate tax, and capital gain tax will not be affected by GST. It would apply to all goods other than crude petroleum, diesel, aviation turbine fuel, motor spirit,  and natural gas. The company adds the GST to the price of the product, and a customer who buys the product pays the sales price plus the GST. The GST is paid by consumers, but it is sent to the government by the companies selling the goods and services. As a result, it provides huge revenue for the government.

 Applicability of GST

As per the current GST law, construction of a civil structure, complex, building proposed for sale is considered a taxable service and subject for GST. Though, GST is only applicable to the construction service if any part of the payment is received before the issuance of completion certificate. This simply means GST is not applicable if the entire consideration is paid after the issue of the Completion Certificate (CC) by a competent authority.

Therefore, if you buy property direct from a builder and you pay any part of the payment to the builder prior to the occupation, GST would be payable on the amount paid. On the other hand, if a property is bought from the owner in a secondary transaction, then there would be no application of GST as the payment is being done after issuance of completion certificate.

GST on Completed Flats

Cases, where completed flats are bought in a secondary transaction, Goods and Service Tax, would not be applicable to such sale transactions. Therefore, it is important to note that GST is applicable only to payments made to a builder for supplying the construction services. Therefore, where completed flats (ready-to-move) or used flats are bought, the subject of supplying construction service does not happen. So, GST would not be applicable to the purchase of completed flats.

GST on flats bought Under CLSS

The Credit-Linked Subsidy Scheme (CLSS) is introduced to give affordable houses to the poor and the lower sections of the society. To become eligible for the scheme, the maximum annual income of beneficiaries is up to Rs 18 lakh. The rate of GST on houses under the scheme will be 8% and not 12%.

The property could be bought under the Credit-Linked Subsidy Scheme (CLSS) at the rate of 8% of GST as follows:-

  • Lower Income Group (LIG)

What is the rate of GST applicable w.e.f 1st April 2019 on the construction of commercial property such as shops, godowns, offices, etc. in a real estate project?

In this situation, since the sale amount is completely paid before the introduction of GST, the benefits do not apply. The buyer will have to pay the Works Contract Tax during property buying.

Let us take an example to understand this situation more clearly. Suppose, you bought a property in 2012 but it is constructed and completed only in 2018. The value of the stated property worth Rs. 40 Lakhs, out of which the value invoiced before 1st July 2017 is Rs. 30 Lakhs. There is also Rs. 10 Lakhs of invoicing after 1st July 2017. That is, there is invoicing before and after the introduction of GST. How will you handle this purchase as far as taxes are concerned?

Before GST, a Service Tax and VAT was being levied on all properties under construction. Hence, there will be a VAT and Service Tax on Rs. 20 Lakhs invoiced before the introduction of GST. After the introduction of GST, the amount payable will be a flat 12% multiplied by the amount invoiced, i.e. Rs. 10 Lakhs in this case.

Property purchased with  completion certificate issued and sale value is completely paid after 1st July 2017

In this situation, since the purchase of property has been completed post the introduction of GST, no tax applies.

Impact of GST Rate on Resale properties

Since resale properties are immovable and do not fall under the definition of Goods under GST, there is no impact. It simply means that there would be no GST on the resale of flats after the introduction of GST.

8% GST Rate on Real Estate under CLSS Scheme

To make the housing sector affordable, the government has introduced several housing schemes for the common public and also providing housing loans at subsidized interest rates. Initially, the government reduced the GST on houses bought with these loans to 12%. The CLSS Scheme finally became 8% after the one-third deduction given to the land.

What are the advantages of GST?

GST has mainly killed the cascading effect on the sale of goods and services. Removal of the cascading has hit the cost of goods. Since the GST regime reduces the tax on tax, the cost of goods decreases. Following are the advantages of GST:

  • Higher threshold for registration
  • The online simpler procedure under GST
  • Defined strategy for e-commerce
  • Controlling the unorganized sector
  • Increased productivity in logistics
  • Lesser compliances

What changes has GST brought in?

In the pre-GST regime, every purchaser including the final consumer paid tax on tax. This taxon tax is described as the Cascading Effect of Taxes. In the end, each time an individual is able to claim the input tax credit, the sale price is reduced and the cost price for the buyer is reduced because of the lower tax burden. The final value of the trousers is therefore reduced from Rs. 3,454 to Rs. 2,970, thus reducing the tax burden on the final customer.

What is the GST registration procedure for taxpayers?

  7. You will then have to create a password for your account after which your registration on the GST portal will be complete and you will be able to log in anytime.

How Does Goods & Services Tax (GST) System Work?

Most of the country has a single unified or centralized GST system, which means that a single tax rate is applied throughout the country. A country with a centralized GST platform merges central taxes e.g. sales tax, service tax, and excise duty tax with state-level taxes e.g. entertainment tax, entry tax, transfer tax, and luxury tax and collect them as one single tax. Under the GST regime, the tax is charged at every point of sale. In the case of intra-state sales, Central GST and State GST are charged. Inter-state sales are chargeable to Integrated GST.

Who will pay the GST tax manufacturer or consumer?

Suppose, goods manufactured in Karnataka and are sold to the final consumer in Delhi. Since Goods & Service Tax is levied at the point of consumption. So, the entire tax revenue will go to Delhi and not Karnataka.

What is Anti-Profiteering?

As per section 171 of the CGST Act, if there is a reduction in GST rate on the supply of goods or services then the benefit of Input Tax Credit should be passed on to the buyer by the equal reduction in prices. However, if the seller fails to reduce the prices after the reduction of GST rates, the matter will be mentioned as the Anti-Profiteering Authorities.

Karnataka CM’s One Lakh Housing Scheme in the State for the BPL Families

Housing has been considering as a basic human need. For this goal, the Karnataka Govt. has drawn up many schemes to provide housing to the homeless people in the state. In order to meet Prime Minister Narendra Modi’s “Housing for All by 2022” target, the state government is planning to develop one lakh affordable housing for people living Below Poverty Line (BPL). The govt has termed the scheme as “CM One Lakh Housing Scheme 2019”. The project is being financed under the central as well as the state govt scheme such as Pradhan Mantri Awas Yojana, The Rajiv Gandhi Awas Yojana, the Ambedkar Housing Scheme, and the Basavanna Housing Scheme. This scheme will be carried out in two phases. People can apply online for Phase-2.

As per a report, approx. 25.36 lakh rural families do not own a house or land. Additionally, 11 lakh urban families have attempted housing under the Pradhan Mantri Awas Yojana (PMAY).

Under the proposed plan, the homeless who apply for housing will be linked with banks for home loans, with the government taking care of the interest payment for a 12 to 15-year period. This is unlike existing housing schemes under which the government gives financial benefits directly to the beneficiaries to construct homes.

Lack of land availability has forced the state to opt for construction of G+14, instead of the previous plan of G+3 floors. Around 1,500 acres of govt land will be recovered from encroachers to build these homes. The scheme is valid for all parts of the city, including Bangalore East, West, North, and South.

About Pradhan Mantri Awas Yojana (PMAY):

Pradhan Mantri Awas Yojana is a govt initiated the scheme in India which intends to give affordable housing for the weaker sections to assure “Housing for all by 2022’’. Begun on 25th June 2015, PMAY aims to build 2 crore houses in a phased manner through the financial assistance of Rs 2 trillion from central government across the country for the urban poor by 31st March 2022 before the nation celebrates its 75th independence.

The Central Govt, in cooperation with real estate builders, visualizes the creation of affordable homes by eco-friendly techniques in selected cities of India. The last date for applying under PMAY Scheme and to get subsidy benefit on Home Loan is 31st March 2022 but the last date for the MIG (1 & 2) categories under Credit Linked Subsidy Scheme (CLSS) was 31st March 2019.

Depending on the areas that it provides, this Housing Scheme has two components – Urban (U) and Gramin (G).

This scheme is converged with other schemes to make sure that every house has toilets, electricity connection under Saubhagya Yojana, LPG Gas connection under Ujjwala Yojana, drinking water, and Pradhan Mantri Jan Dhan Yojana banking facilities, etc.

Under the PMAY scheme, there is a Credit-Linked Subsidy Scheme on home loans for properties in the urban areas pertaining to Economically Weaker Section (EWS), Low Income Group (LIG) and Middle Income Group 1 & 2 (MIG). It can be utilized for new as well as for the resale buying of a home, construction, or for expansion or renovation of rooms, kitchen, toilet, etc.

This ambitious project has 4-components namely, In-situ Slum Redevelopment with private sector participation using the land as a resource, affordable housing through the Credit Linked Subsidy Scheme (CLSS), affordable housing in partnership with private and public sector and beneficiary led house construction. Under these components, central assistance will be in the range of Rs 1 lakh to Rs 2.30 lakh

PMAY is an effort by the government to encourage buying in the real estate sector, and this cost of housing development will be shared between the Central and State Government in the following directions:

 64:40 for plain regions.

90:10 for North-Eastern and hilly areas.

PMAY Features:

  • The features of Pradhan Mantri Awas Yojana are that the government will provide an interest subsidy of 6.5% for EWS and LIG, 4% for MIG-1 and 3% for MIG-II on housing loan availed by the beneficiaries for a period of 20 years under Credit Linked Subsidy Scheme (CLSS) from the start of a loan.
  • The house under Pradhan Mantri Awas Yojana would be constructed through a technology that is eco-friendly while allotting ground floors in any housing scheme under PMAY.
  • Preference will be given to differently-abled and senior citizens.

1. Pradhan Mantri Awas Yojana Urban (PMAY-U)

Presently, the Pradhan Mantri Awas Yojana Urban (PMAY-U) has around 4,331 such towns and cities under this scheme. It also involves urban development authority, special area development authority, industrial development authority, development area, notified planning, and every other authority which is responsible for urban planning and regulations.

As per the Ministry of Housing and Urban Affairs data, the pace of progress of PMAY-U in all states and union territories, as of 1st July 2019 are as follows:

2. Pradhan Mantri Awas Yojana Gramin (PMAY-G)

The Pradhan Mantri Awas Yojana Gramin (PMAY-G) was earlier called the Indira Awas Yojana and it was renamed in March 2016. It is aimed at improving the convenience and affordability of housing for all of rural India with the exclusions of Delhi and Chandigarh.

The goal is to grant financial support to the homeless and those living in old and dilapidated houses to help them in building the construction of pucca houses. Beneficiaries living in lowlands can get up to Rs. 1.2 Lakh and those in North-Eastern, hilly areas, Integrated Action Plan (IAP), and difficult areas can benefit up to Rs. 1.3 Lakh as a result of this housing goal.

Currently, as per data available from the Ministry of Rural Development, 1, 03,01,107 houses have been approved in all states and UTs.

Note:-

  • Apart from that, there is some necessary condition an applicant has to match. For example, if the beneficiary is a family, it must include a husband, wife, and unmarried children. Also, no person from the family should own a house in their name.

  • In the case of a married couple, either a single or a joint ownership sale is allowed, and both options will get just one subsidy.

As the PMAY website uses a unified platform, the slum dwellers require to use the same application to apply for a house under PMAY. While all the steps mentioned above will be followed, there’s a small change you should know:

How to get the subsidy under PMAY?

  •  Apply for a home loan from a principal lending institution if you are looking for a subsidy.
  • If qualified for the subsidy, your application will be sent to the Central Nodal Agency (CNA).
  • If it’s approved, the CNA will dispense the subsidy amount to the bank.
  • This will be credited to your account, hence, decreasing the total loan amount.
  • For example, if your annual income is Rs 7 lakh and the loan amount is Rs 9 lakh, the subsidy will be Rs 2.35 lakh.

The process to check the PMAY 2019 application status with Assessment ID:

  • Step: 1 – Log on to the Pradhan Mantri Awas Yojana website: http://pmaymis.gov.in/Track_Application_Status.aspx or go to the ‘Citizen Application’ option and then choose the ‘Check Status’ button.
  • Step: 2 – When you click the track button, there will be two options displayed: ‘By Name, Father’s Name & Mobile No’ and ‘By Assessment ID’.
  • Step: 3 – Choose the ‘By Assessment ID’.
  • Step: 4 – Enter the Assessment ID & Mobile Number that was shared with you when the form was filled and submitted.
  • Step: 5 – After filling up details, click on the ‘Submit’ button.
  • Step: 6 – The user will soon know the stage at which his/her application is

About PMAY-(G)

It aims to provide a pucca house with basic amenities to houseless, households, and households living in Kutcha and dilapidated houses in rural areas by 2022. To achieve the objective of “Housing for all” the target number of houses to be constructed by the year 2021-22 is 2.95 crore. The immediate objective is to cover 1.00 crore households in rural areas, that are homeless and living in Kutcha/dilapidated houses, in three years from 2016-17 to 2018-19 and enable the construction of quality houses by the beneficiaries using local materials, designs, and trained masons. In Total, 4 crore households will be constructed under the PMAY-G scheme by the year 2022. The estimated total expenditure of PMAY-G is Rs.60,000 crore

The minimum unit size increased from 20 sq.m  to 25 sq.m including a dedicated area for hygienic cooking.

Enhancement of unit assistance from Rs 70,000 to Rs 1.20 lakh in plains and from Rs 75,000 to Rs 1.30 lakh in hilly states, difficult areas and IAP districts.

Provision of assistance Rs 12,000 for toilets through convergence with Swachh Bharat Mission-Gramin (SBM-G), MGNREGS or any other dedicated source of funding.

PMAY-G (Scheme Cost)

The total cost of the program of PMAY-G is Rs 1,30,075 cr for construction of 1.00 cr houses by 2018-19. The cost would be shared between the GOI and the state govt. in the ratio of 60:40. In the case of the North-Eastern States and the three Himalayan States viz., J&K, Himachal Pradesh and, Uttarakhand, the sharing pattern is in the ratio of 90:10. Govt of India would provide the full cost in respect of Union Territories (UTs). Totally, 4 crore households will be constructed under the PMAY-G scheme by the year 2022

The central share of the total cost of the program works out to Rs 81,975 crore out of which Rs 60,000 crore would be met from budgetary support and Rs 21,975 crore would be met through borrowings from National Bank for Agriculture and Rural Development (NABARD), which would be amortized through budgetary grants after 2022.

Allocation of Scheme Funds:

From the annual budgetary grant for PMAY-G, 95% of funds would be released to States/UTs for the construction of new houses under PMAY-G. This will also include a 4% allocation towards Administrative expenses. 5% of the budgetary grant would be retained at the Central Level as a reserve fund for Special Projects.

The target of providing 10 million houses to the rural poor by the end of FY19 under the Pradhan Mantri Awas Yojana – Gramin (PMAY-G) is likely to be missed by the government. This speculation has emerged after a government official recently stated that only 8.6 to 8.7 million houses were expected to be completed by April 20.

The delay has been accounted for factors like land not being readily available, refusal of beneficiaries to move from the dwelling areas for construction of houses, etc. While in states like Punjab, Haryana, Andhra Pradesh, and Kerala, there aren’t enough approved beneficiaries to meet the targets.

It needs to be mentioned here that in FY20, as many as 6 million houses are scheduled to be completed under the scheme. Given the fact that individuals can get Rs.1.2 – 1.3 lakh for a house under the scheme, it has been approved for another 19.5 million houses by 2022.
