Q:Out of approx 120 plots we are currently about 18 members who have come together and wish to form a society. The purpose to do so is to identify a contractor to whom we wish to give work such as laying down the water pipes, building tar roads etc. Would appreciate if anyone could guide me here as to what is the procedure to form a society of open plot owners and what are the documents required fees etc? The plot is located 17KMS from Karjat station
Q:When is an association legally considered as the sole representative organisation of layout plot owners to interact with builder and government?how many/percentage of owners need to be members of the association for it to be considered valid representative organisation for that layout/community?What options are there for owners to be part of the association without having to be present while registering the association?
Latest Answer: A minimum of seven person required to form a society, a memorandum should be prepared which will include the name of the society, objects, name, address and occupation of the member of the committee. A society need to make a bye-law for conducting the affair of the society which have to be filled by the registrar of the societies. If the bye-laws and memorandum are in accordance with the legal requirement then the same can be registered. The bye-law or memorandum have to be typewritten or printed and should be signed by all the members of the society.
Q:I have been penalised to pay Rs1000/- more for paying 3 months charges of society of Rs 9000/- from Oct to Dec 11 . Last date was 30th Sept and I paid on 17th Sept11 . This amounts to charging penalty of more than 100% per annum which is against society by laws . All such defaulters must come together and fight this out .
