Q: I am selling my flat and buyer is taking loan on my flat and he is saying after That I will give you money and the process of registration is already done with sub register office already he has taken all the original document but now he want NOC from my society and my society is giving NOC but on my name but purchaser is insisting take NOC on his name. Plz give me suggestions what to do.
Latest Answer: Have you transferred the ownership rights to your buyer if not then your society will issue the NOC in your name only. Until and unless you don't transfer the ownership rights to the new buyer, NOC will be issued to your name only. So, try to make him understand about the legal procedure.

Q: Wanted to know if the NOC from CIDCO is required for transfer of housing society membership for re-sale flat. The flat is in a building constructed on plot based on tri-party agreement. The price of flat has been fully paid up to the seller, without any loan, and agreement duly registered.

To give a brief history. after the OC from CIDCO, and after Housing society was formed, just when builder in process of providing conveyance, which he eventually did, one fine day a letter from a lawyer was given at the gate. It mentioned that the set of heir's of original plot owner had put up a court case against Builder, CIDCO and another set of hier's. Former set of heir's were claiming that latter set had shared the compensation with them. We, the members of housing society, consulted a lawyer, who told use this is not unusual in this region, we should not worry, as the case has not been filed against us, unless there is direct notice to us.
But now after few 3-4 years, when resale of flat went ahead, now the present Housing society committee are denying to transfer membership to the new owners, after CIDCO has not provide NOC.

So is NOC CIDCO required for resale of flat not built by CIDCO, and when there is no home loan involved ?. And a housing society deny transfer of membership to the new owner with CIDCO NOC ?

Latest Answer: In Navi Mumbai, Secretary of Shahjanand CHS Ltd Sector 21 is refusing to issue NOC to sell my flatfor want tofCIDCO transfer. My Seller has been issued NOC to change the name but wehereas my appln was rejected to change Name on Share certificate of CIDCO. Hence my membership to become a Member of the Society as well as to Sell the flat also. I need advise on this.

Q: Maharashtra Government has simplified the procedure to convert farmland into non-agriculture land for plots covered under Developments plan in urban areas.

Latest Answer: As Ajit has mentioned, land owners will have to seek the permission of the municipal body for their non-agricultural plans. Once the municipal corporation or municipal council gives the go-ahead, the owner just needs to intimate the collector in 30 days. No permission from the collector is required. Revenue officials will then recover a one-time land conversion tax and a non-agriculture cess. This process will apply to those who are direct owners of the land. For those who have leased land from the government, the collector's permission is still required, though the conversion procedure has been made simpler for them as well

Q: The civic body will now allow builders to obtain no-objection certificates through private consultants instead of civic officials.
Latest Answer: Hi everybody, I appreciate the initiatives but at the same time i would like to say that there are many more issues with the approval process such as numbers of approvals and number of officers a builder has to go to for procuring permissions, BMC's software which is full of junk and civic officials are trying to force them to use it etc. This needs to simplified.

Q: Hi,

I have resold a flat in Lodha Palava ,Mumbai of which I have possession. There is no OC and no society has been formed.

Lodha has asked for NOC charges in cash and not in cheque.

They said that even bank like ICICI, HDFC etc. can not give loan. Is it true?

Is this NOC and these charges valid.
And does buyer and seller has to bear 50:50?

I am salaried.

Latest Answer: Hi Guys, The CHB had chosen November 12, 2012 that in future all kinds of transfer cases, no-objection certificate (NoC) for selling property and conversion from leasehold to freehold as well as execution of conveyance deed will be managed strictly when taking the most recent investigation report with respect to building violations.
