Q:HiI am in the process of buying a resale flat in Kandivli Area. It is a 2BHK flat.Here is the situation:- Original agreement from Builder to first owner had 3 flats each of 210, 235 and 195 sq ft carpet area- However, the building was constructed differently for some reason and all 3 flats were combined into 1 with total carpet area of 720 sq ft- Agreement from Builder to first owner has 3 separate agreements with 210,235 and 195 sq ft- Agreement from First builder to second builder has 720 sq ft carpet area- Society NOC provided at the time purchase made by second owner has 720 sq ft carpet area- Index 2 page has 720 sq ft carpetMy concern is why is there a difference between original agreeement and all other agreements. Also, is it safe to go ahead with the deal? Are there any other documentation that I should be checking to be extra sure on this?Please adviceThank you and good luck!

Carpet area - Carpet area is the area that can be used to spread a carpet inside the house. It is the net usable area of the apartment. It includes the thickness of the internal wall but excludes balcony or terrace.
Built-up area - built-up area is the carpet area plus the area covered by walls. The built-up area includes balconies, terraces (with or without roof), and other detachable habitable areas such as servant room, etc.
Super built-up area - Super built-up area is the built-up area in addition to the proportionate share of entrance lobby, corridors, stair cases, lift shafts, lift lobby, generator rooms, club house, security room and any other common areas in the complex.
These rules are applicable most parts of India including Hyderabad too.

Q:Since RERA ACT has no notion of built-up or super built up area and only includes carpet area, will the registry of apartment be on the basis of carpet area?

We often see the advertisements flashing something similar to, Buy an apartment at just Rs 3500/sq-ft.!! but when we registered the flat the @3500/sq-ft. then it come to know that it is just the basic price, the actual price is much more than that. Is it true?

The draft rule also makes it mandatory for builders to use units and symbols of measurements prescribed in Legal Metrology Rules 2011. No weighing or measuring instruments except those specified by Legal Metrology Rules 2011 shall be used for measurements. Such instruments shall be periodically verified as required under the new Act.
It s also notable that now builders can't advertise apartments in terms of square feet as has been the standard practice in the construction industry.

As per my knowledge, the loading factor is constantly figured as a percentage. This changes from project to project and cities to cites. For example in Delhi-NCR, it is 20%-40%, in Bangalore 20% to 30%. Similarly like in Chennai ,it is 25% to 30%. In Mumbai metropolitan region, loading factor is more than compared to other cities, 50%-60%.
