B-Khata Could Not Be a Basis for Property Registration

Any land that has not been authorized for residential or commercial use by the state government is referred to as ‘revenue’ land. The property tax collected from such a building should be maintained in a separate register. The BBMP registers such property under what is called a B register. Site owners who had their revenue land converted by the Deputy Commissioner (DC) from agriculture land to non-agriculture land purposes had a relatively easy transition to the BBMP fold.  To tap the vast catchment of revenue, the BBMP began advertising a ‘B’ register to draw property taxes from site owners who were to be extended the civic amenities, but had not been part of the BBMP earlier. However, over the years, the ‘B’ register has been mistaken to be a ‘B’ Khatha.

B-khata is a Bogus

Bangalore BBMP commissioner Siddaiah said B-Khata could not be a basis for property registration. B-khata is just a register maintained by the BBMP to collect taxes from the revenue property holders. B-Khata is not considered as a valid Khata extract. The statement has put thousands of property owners in confusion as many of them are being encouraged by the Palike officials themselves to get the B-khata and get on with property registration and other transactions.

The B-khatha does not exist on paper. A serious effort would be required to tell people that there is no such thing as a ‘B’ Khatha. The issue came into focus when it was found that BBMP authorities issued B-Khatha for revenue sites although the Karnataka Municipal Council (KMC) Act did not mention about B-Khatha. This was considered a rampant violation of the KMC Act. Construction of many houses was in violation of the BBMP building by-law and KMC Act.

What is B-Khata?

There is nothing called a ‘B’ Khatha in the KMC Act, 1976. What has come to be known as ‘B’ khatha is the ‘B-Register’. The property tax collected from any land that has not been authorized for residential or commercial use by the state government and who had their revenue land converted by the Deputy Commissioner (DC) is maintained in a separate register called a “B-register”. However, over the years, the ‘B’ register has been mistaken to be a ‘B’ Khatha.

It has been noticed that some BBMP engineers and revenue officials have been encouraging people to build houses without the sanctioned plan if they have paid tax under the B register. The property owners are also convinced that they can get it regularized through Sakrama scheme. Khatha can only be extracted on a title deed and cannot be considered as being a title deed by itself. Khatha literally means an account, This Khatha is an account of a person who has property in the city. Obtaining a Khatha does not confer ownership of property, but confers the person who is liable to pay property tax. In case a property owner wants to sell his property, he will be required to transfer the Khatha.

    For the last few year, here has been total confusion on the A KATHA AND B KATHA. a PERSON APPLYS FOR LOAN AND THE SALE DEED IS DRAWN AND THE SAME IS PLEDGED TO THE RESPECTIVE BANKS FOR LOAN. WHY ARE BANKS SANCTIONING BANK LOANS WITHOUT PROPER SCRUTINY OF THE CONVERTED LANDS. OF COURSE, BBMP HAS BEEN SANCTIONING PLANS TO THE LAND LORD AND WHO IN TURN CONSTRUCTS APPARTMENTS AND SOLD TO INDIVIDUALS WHO SHELL OUT HUGE SUMS. HENCE, EITHER KATHA SHOULD SERVE THE PURPOSE FOR FUTURE PROPERTY TRANSFER.

    Sir, I am born and bought up in bangalore and I still do not have a site in my name now a days BDA is also not alloting any site and more over Govt., BBMP is issuing B-Katha on DC converted land, if I build a house on taking loan from bank will there be any issue and will Govt., take back our site is yes,why Govt., is not comming forward and allow BDA to allot site to people like me.

    AKRAMA SAKRAMA is not done by the government. GOVERNMENT IS ALSO NOT INTEERESTED IN THIS REGARD IT APPEARS SO. IT IS HELDUP FOR SO MANY REASONS. I AM ALSO WAITING FOR THIS SCHEME SINCE MORE THAN 7 YEARS. NO USE. NO MARKET VALUE TO SELL/REGISTRATION NOT POSSIBLE; NO BANK WILL GIVE LOAN ALSO TO CONSTRUCT HOUSE. ALL WASTE. THIS IS OUR SYSTEM.

    As the above said particulars A katha means the property has paid betterment charges or development chargers to the concern department B katha means betterment charges not paid for the property and no plan sanction will not given to the B katha properties .

    I purchased flat which had A Katha, now along with deed of declaration & up to date tax, BBMP issued me B katha stating that there its deviation in construction. I know BBMP officials are asking for OC & PC, whereas builder is not bent on spending money for OC, by what way I can bapproch for A katha, pls advise

      THe property once issued with A – Katha, it will issued only A – Katha in future, you can check with ARO BBMP of the concerned area

    “B” Khata or “B” Register Form Property is safe and there is no worry about the transaction , as 30% of Properties situtated in Bangalore are in the form of “B” . “B” Khata Properties can be bought and sell in the market.

    Loan Can be availed for “B” Khata Properties either on Land or Building.

    We are preparing to purchase and apartment in Bangalore. The seller of the property that we are interested in does not have a A-Khata.
    The construction of the building is not 100% completed and the builder does not have the “Occupancy Certificate” yet.
    Is purchase and registration of this property possible in this scenario with a B-Khata ? My friend along with the seller checked with the Registrar in Begur registration office and she confirmed that registration can happen based on B-Khatha.
    Purchasing and registering of apartments while it is under construction and resale of the same should be a common occurance in Bangalore.
    Can someone who has been in this situation or has the knowledge of this please provide your advice on this ?

    almost all revenue sites are owned by Reddys. 80% of Bangalore population since 1980 have been buying and constructing houses on agricultural land. Why suddenly a Reddy person has come out and made such a pain for the residents of bangalore? Another scheme to rip the citizens off hard earned money by the cash hungry babus. this has been happening for more than 50 years. Why only now its big issue? all scam by politicians to disturb peaceful citizens and cause confusion and make some money out of it.

    If B Khata is bogus, does anyone who has bought “B Khata Property” at their own risk, should even bother to change it again to another “B Khata” in their name, until the scheme to convert the B Khata to A Khata is regualarized by the Govt?
