Q: The Builder indicated in his brochure that the 2BHK Flat will be given possession by 31st Dec.10 and so far not given as construction was at snail's pace. He has mentioned in the agreement that Rs.5/- will be given for the delay, if any, per month. After paying Rs.28 lakhs we have stopped further payments as the construction was very slow. Now, the builder is unwilling to pay even the paltry compensation mentioned above and intends to charge 18% for the balance amount due to be paid. (i) For his inordinate delay, whether we can demand higher compensation? (ii) Whether National Consumers' Commission or Supreme Court has given any Ruling on such errant Builders? (ii) How far it is justified that he is withholding payment of compensation and on the other hand invoking the clause of 18% blaming the owners as defaulters? Whether National Commission for Consumer Grievances or Apex Court has given any judgement in this regard to tame/discipline the Real Estate Companies?

Apart from what Vijaya Laxmi has mentioned above, the builder is now declining to provide the shower panel and shower cabinets in the flats despite initial committment. Q: Hi, I gather that Gardenia folks are not providing the shower panel and shower cabinets despite initial commitment. Please let us know if you have the same information.

I have purchased an apartment in Gardenia Grace and i talked with the contractor there and he told me that he didnt have any info about providing the shower panel and shower cabinet. Gardenia has already started sending the possession letters and many future occupants are getting their woodwork done as I write here. Gardenia is surely doing a good job by providing high quality stuffs like Havel's electricity and Jaguar sanitory fittings. Appreciation is also quite significant. The elevation is great. Just the main gate needs to be more fancy. However all this excellency is leveled due to the delay in project. People, who are on rented accomodations, are really losing money due to the delay. I also heard that the Noida's circle rate is going to be revised by some significant amount in near future, this will again have an impact on buyer's pocket in thousands (if not lac), if the flats are not registered ASAP. The registration process cannot start before Gardenia receives a "Project Completion" certificate from the relevant authorities, which will take another 2-4 months. Nor can buyers have electricity meters installed and operational till then. I gathered from Gardenia people that they are providing Kent RO system. Not sure of the capacity in Ltrs though.
