Q: My flat in Mulund was registered on 29/09/06 and handed over by the builder on 29/02/08 after payment of all dues. Society has also been formed. The builder is now demanding VAT @ 5% of total agreement value. Is it valid/legal? - MK Reason cited by the builder is the judgement of Bombay High Court on 11 April 2012 against an appeal of a builders' association challenging inclusion of housing/real estate under the purview of VAT by Maharashtra Govt in the state budget 2006.

I heard that developers have to pay 1% VAT charges to govt. and that's the reason they are requesting buyers to pay. But it is not 5% I think. VAT+Service tax is 1%+2.575%. I have registered the flat on Nov 2011. I am getting possession by Sep 2012. Q: Hi Friends, the biggest problem is not about getting flat on time but about questioning Builder or Govt. how much an individual should pay extra amount as taxes to govt... in every scenario only individual gets pain... Due to this recent VAT our flat cost gets increased by Rs.700 per sq ft. If we were living in the bought flat, pain would have been less but that's not the case. Also the biggest problem in India is everybody is good in talking but nobody takes initiative to get relief from this regular pain, by bringing every one at floor and taking action against builder.

Q: Fitting of tiles not in level due to bent in tiles. may be it is due to low grade tiles. lining of tiles doesnt match in all rooms. supervisor doesnt have time to look for complaints. Not satisfied as people talk rudely after having bought and complaints are not acted upon. Experience is very very bad. however this are my views as per my experience.

Yes in Bangalore all buying/selling have to execute sale deed, but I have seen in some constructions the Builder waits till Society formation and then only once Executes a Conveyance Deed which hand over the Property from Builder to the Newly formed Society. Can someone validate this?Yes in Bangalore all buying/selling have to execute sale deed, but I have seen in some constructions the Builder waits till Society formation and then only once Executes a Conveyance Deed which hand over the Property from Builder to the Newly formed Society. Hello Shiva..some builders do not take approval from HMDA which is compulsory. Before booking ant apartment make sure you collect all necessary documents from builder. Hi Kaushik...if you are purchasing a property by your NRE account then you can only repatriate the amount that you have spend on acquiring the property. I hope you know that here the restriction is that you can only repatriate money for two residential properties But if you use your NRO account then the restriction is more i.e you cannot repatriate that money for ten years and on the payment of taxes you can take your money back. And if you but property in the name of you parents then it becomes your inhereted property and for this the government allows you to repatriate almost 4 crore in a year. Hi Nityanand, earlier it was 1 lakh only.. recently it was said by the Ministry of Housing and Urban Poverty Alleviation that it is planning to increase it to 5 lakh..
