Q:
Guys as you all must be knowing that our project has been delayed by more than 2 years. In my each meeting and written communication with LODHA 'bout the compensation for the delay possession, I was getting replay that that will be adjusted during the possession demand letter. But now last week when I asked my customer representative for a site visit, she asked me to pay the remaining 5% of the consideration i.e. nothing but the possession amount else I won't be allowed for a site visit. And she also confirmed LODHA is in no mood to pay the compensation to us for the delay payment. I asked her that by saying this they are breaching the contract mentioned in the Sale agreement. They said they don't bother 'bout this. So guys I've decided not to pay the possession amount and go to the consumer court. I also think you all will get the same response when you'll be aksing for the compensation. Guys please share your experience and opinion.
I too have got an email from Lodha telling me that there is no compensation payable as the delay was on account of non availability of sand and labour and clearances from authorities. This is very unfair on their part.

Q:
How many people have taken fitout possession? Is there any information about it?
The builder is saying that OC will come in about 6-8 months. What is the point to taking fitout possession other than paying the builder the full amount?
Why is the builder charging CAM from 31st, October? My understanding is that as long as the builder doesn't given possession (full possession where I can live in the building) they have possession of the property and therefore any maintenance is their responsibility. How can this be transferred to the buyer without giving possession?
The builder has indeed changed the name of the project to 'Splendora' or some such. I got a letter about it a few days back.
Regarding CAM, both on overcharging as well as starting it before handing over possession, we need to seek legal opinion. Anyone here know a legal expert we can talk to? The builder has indeed changed the name of the project to 'Splendora' or some such. I got a letter about it a few days back.

Q:
For Casa Univis (or is it now Splendora?) Egnis E, I once again got a call urging me to take Fitout possession. They are not offering any information on OC and consequently the final possession except to say that they have applied for it. But they are trying to get more money out of me by offering fitout possession.
Also, on CAM they are saying that it will start from Jan 15, 2013. When I don't have possession of the flat how can they expect me to pay for maintaining it? Also, they have not addressed the issue of doubling the maintenance charges from what was agreed upon.
Also, when I asked them if the clubhouse, pool and other infrastructure is ready, they haven't answered in the affirmative. These, by the way, are what this maintenance charge is supposed to be going towards. So, basically Lodha expects the buyer to pay for maintaining infrastructure that isn't ready yet and that the buyer doesn't legally have a right to use.
Hmmm.... Does anyone have the original brochures or plans. Surely they cannot cancel something they have sold as part of the amenities. Hmmm.... Does anyone have the original brochures or plans. Surely they cannot cancel something they have sold as part of the amenities.
Rajesh,
Thanks for the update. Surprising to hear that some flats are already occupied. Is this the norm? Sad to hear about the size of the swimming pool. I've seen other Lodha properties and generally their club house and pool are of a good size. Let's assume the main club house will be bigger and better. Rajesh,
