Q: Guys as you all must be knowing that our project has been delayed by more than 2 years. In my each meeting and written communication with LODHA 'bout the compensation for the delay possession, I was getting replay that that will be adjusted during the possession demand letter. But now last week when I asked my customer representative for a site visit, she asked me to pay the remaining 5% of the consideration i.e. nothing but the possession amount else I won't be allowed for a site visit. And she also confirmed LODHA is in no mood to pay the compensation to us for the delay payment. I asked her that by saying this they are breaching the contract mentioned in the Sale agreement. They said they don't bother 'bout this. So guys I've decided not to pay the possession amount and go to the consumer court. I also think you all will get the same response when you'll be aksing for the compensation. Guys please share your experience and opinion.

Q: I am interested in a property in Chennai Velachery, which the Seller had purchased in a Bank Auction. I have few doubts. 1. Is it safe to buy such properties, could there be any legal problems in future? 2. The origianal Owner had got plan approval to build 2400 SqFt in a Plot of size 3000 SqFt but built only 1200 SqFt on the ground floor. He did not build on the first floor, though he had approval. He defaulted on the Bank loan and the property was auctioned with 1200 SqFt building mentioned in the Sale Deed. This person who purchased the property built the first floor without any fresh approval. There are separate Property Tax and EB connections and cards for both the properties. Now if I buy the property what should I do to avoid Corporation's action or to create value or to get loan against the property? Kindly advise.

Hi Mayank, tenant only will have to pay maintenance fees since it is the tenant who will be using the flat, facilities and common area.. If owner has paid deposit then it will be returned to him by the association. But if it is funds required for repairs and new installations, etc. then owner will be paying it. My comments to replies
Obviously the tenant will use the flat. Thats why he is a tenant & he pays rent & for that. If the entire maintenance is passed on to tenants, it will disturb the supply & demand situation. There are flats that are currently vacant and a lot of people are starting to move to them. Otherwise there are flats nearby like Sobha Sunscape etc where rates are still unchanged. The reason there was no maintenance earlier was because owners had given deposits. If deposits were not to be returned & only additional maintenance was charged it may have been around Rs. .75 -Rs. 1.00 psft. But the maintenance is currently fixed at 2.75 per sft only because deposits are being returned. So the entire 2.75 is not a burden to the owner. Its only the additional amount of around Rs. 1 per sft.
I think you are right.. so what do you think is right in this case..
