Guys as you all must be knowing that our project has been delayed by more than 2 years. In my each meeting and written communication with LODHA 'bout the compensation for the delay possession, I was getting replay that that will be adjusted during the possession demand letter. But now last week when I asked my customer representative for a site visit, she asked me to pay the remaining 5% of the consideration i.e. nothing but the possession amount else I won't be allowed for a site visit. And she also confirmed LODHA is in no mood to pay the compensation to us for the delay payment. I asked her that by saying this they are breaching the contract mentioned in the Sale agreement. They said they don't bother 'bout this. So guys I've decided not to pay the possession amount and go to the consumer court. I also think you all will get the same response when you'll be aksing for the compensation. Guys please share your experience and opinion.

I found this blog very useful. I booked a flat in CASA UNIVIS CEILO in 2009 and as we know it is far from posession stage. the posession date has been moved 4-5 times now (the revised date is May 2014).
Unfortuantely I am outside India so I am a bit constrained with what I can do.I am very keen on joining any group/forum to take this fight with Lodha on all the issues discussed in this forum. I will appreciate if one of you can share either your contact details or any forum/group details so that I can also join.
I think unless we make this initiative big enough so that it impacts LODHA, we will not get desired results - so more owners can join, better it is for this Group.Hi Guys,

When I first booked a flat in this project, I was very excited and looking forward to living in this community.. But it's been more than 3.5 yrs, it is still under construction and as per the latest communication it will still take another year; this is very disgusting given the fact that they committed to deliver within 1.5 to 2 yrs and compensation if there is a delay. But there is no compensation given and false possession dates are being provided every time. So far the possession date is changed at least 6 times now, giving the silliest reason ever - 'Unavailability of labour'. How the hell they cant find labour from the entire Mumbai region? Whereas on the other hand they are starting couple of other projects every now and then. They are just there to take your money and enjoy the interest of it without thinking about You - The Customer. Poorest customer service. One important learning is never go on brand name.
Very Very very unprofessional and misleading people and project.

Thanks for sharing your issues. I also booked a flat in 2009 and since then watching the circus of Lodha CASA Univis(delays, further delays, loan approval issue with banks, No approvals, short of raw material/labour etc.). I appreciate that legally, we might have limited options considering the way contracts have been written and also huge legal team which big builders normally have.
But I strongly feel that we should keep sharing our views/experiences on this (and similar) forums and try whatever measures we have (consumer court etc.) so that it brings more awareness and information for rest of us. I am also surprised (may be not) that none of the media/newspapers have written anything on this topic considering there are articles on Thane properties every week.
I hope these forums also make builders realise that their new project could be impacted if their brand is impacted by negative publicity/comments from existing clients.Thanks for sharing your issues. Hi All,
I contacted Lodha today and was informed by Vivek Koshti that the possession date for Ceilo C is going to be further postponed to May 2014. They will be sending the letters/email to all the customer next week. This is due to not getting approvals from TMC.
They also informed that they are not planning to pay any compensation/interest payment for the delayed possession as the reason for delay is beyond builders control.
I booked the flat in 2009 and have been paying the interest on loan to bank for last 2 years. I am not comfortable to continue paying further cost for Lodha not managing the project efficiently. I am planning to seek legal options for what can be done in this scenario apart from going to consumer court. I will appreciate if you guys can let me know if you have received any communications from Lodha on this and if you are planning to take any legal action.

Both the options do not make any sense -
Option a. Cancellation of booking and refund @ 12% - Lodha is selling the new properties in the same project @ 8100+ psf and expecting the buyers who have invested @ apporx 4000 psf to take the refund @ 12% so that Lodha can resell those flats along with other inventory at a much higher rate.
Option b. Continuing you booking – Lodha wants us to wait for another 2-3 years without a concrete finish date (i.e. 22 months after the approval, which he might not get for another 6+ months) and also forgo our right to any interest for delay in possession.
These options just show that builder thinks all us are at their mercy. I don't think we are under any obligation to accept these options. I agree we should get together and start an initiative against the builder. My e-mail ID is Kapoorbharat@gmail.comBoth the options do not make any sense -
