Q:
I had purchased under construction flat and made agreement on Dec2010 @ Rs. 14,31,000/-,in Indore M.P.I had paid Rs. 11,40,000/- in installments Rs. 6,27,000/- till March'2011 and 5,13,000 in Nov'2011.Now builder is asking balance 2,91000/- with additional Service tax of 3.09% on 14,31,000/- and VAT of 5% on Rs 14,31,000/- as flat is ready for possession.
Important point.
* In the receipt of 6,27,000 , the service tax inclusion not mentioned.
* In the receipt of Rs. 5,13,000, included service tax @2.575 is mentioned.
Now my question is
1. how much I have to pay
a) Service tax @2.575% of 5,13,000/- plus 3.09% of 2,91,000/- and VAT of 5% on 14,31,000/- OR
b) Service tax @2.575% on 11,40,000/- plus 3.09% of 2,91,000/- and VAT of 5% on 14,31,000/- OR
c) Service tax @3.09% and VAT of 5% on 14,31,000/-
2. How one can insure that builder has deposited ST and VAT to government?

Latest Answer: Hey ashish..it is better to have a discussion with the builder itself...Make sure you come up with a solution. I'll also suggest you to take some legal advice.
