The encumbrance certificate is issued in Form No. 15 and 16. If the property does not have any encumbrance during the said period, Form 16 will be issued i.e., certificate of Nil Encumbrance. If the property has any encumbrance registered during the said period, then form No. 15 will be issued.

We have a plot 45* 75 abutting 30 feet road at anna nagar, whether we can consturct five flats of equal size one in slilt floor , two each in first and second floors , each of 1000 sft carpet area. Since few people said that u cannot construct any flat in slilt even it it comes under fsi, i am seeking clarification
Hi Priya, The basic rules laid down by the CMDA divide buildings into three types, ordinary buildings, special buildings and multi-storeyed buildings. This classification is based on the height of the buildings and the number of households in a plot and extent of commercial activity.

Q: Olympia Opaline are totally unreliable people. They promised delivery of Amber block flat in April 2011. They are delivering in April 2013. ( Even now, lifts are not operational fully ) Everytime they were extending the time by around 3 months. Only second rated companies and totally unreliable companies will do like this i.e. will delay for 2 years. Olympia Opaline has joined in that group. Buyers should be careful while selecting a buyer. Otherwise, they will be forced to incur huge loss by way of ( bank loan ) interest for the delayed period. When the question of compensation arises, they will speak about agreement. When the question of honoring of their own commitment arises, they will function like a second rated company. BUYERS MUST BEWARE.

Q: Recently I went to JS looking to rent a flat but I was confronted by the watchman at the gate ,who asked me to meet Madhan for rental issues .Upon talking to him he asked me for 1 month's advance as commission .But I declined his offer and later I managed to rent a flat here without paying any commission.Having moved here I came to know that the Maintenance company DFMS is run by Madhan under the patronage of a resident in JS who seems to be part of JASFOA officials.Also the Aavin milk contract is taken by this JS resident and it is being implemented by Madhan on behalf of the JS resident.So even if the Maintenance company is changed Madhan will remain here.JS will be a better place only if this guy is shown the door.

Q: I heard about real estate regulation bill, that the centre is hoping to bring in the twin states of Telengana and Seemandhra. Is this true guys? Will this bill be in favour of the buyers or the builders?

Yes you have heard right about the real estate regulation bill. And as you said, it is being developed by the centre, although it is not just for the twin states. They are going to be developing this bill keeping the whole of India in mind. I think this kind of a bill is highly justified and called for, because the real estate sector could do with a lot more transparency. I’m going to keep an eye out for the winter session of the parliament, because that’s when they are hoping to introduce this bill.
Right Kasif, It is very difficult to deal with these kind of developers in the current real estate market. But as per the new real estate bill 2015, if wrong declaration of information about the project is found from the builders side then payment of 5% of project cost will be imposed. The Bill provides power to the regulatory authority to cancel their project registration in case of continue violations and decide on further course of action regarding completion of such projects.

Hi , In my point of view, the primary purpose of OSR is to use the reserved area for community or recreational purposes such as residents association, park or play area by the residents of the development. CMDA has the responsibility to ensure the maintenance of OSR. If CMDA is not satisfied with the maintenance of OSR, it has the right to ask the owner of the land to transfer the land to CMDA by gift deed.
Hi All, In my point of view, one more thing is important that, it is necessary to pay the OSR charges before obtaining layout approval. Certain layouts designated for infrastructure projects or classified under special categories such as the Archeology Survey of India ASI) restrictions may not get approval.

Hi Mr Kumar, As per my knowledge, Flat owners association can be registered under Tamil Nadu Societies Registration Act, 1975. The number of people needed to form a flat owners association is 5. Before apartment ownership act 1994, the minimum number of owners needed to form the apartment owners association was 7.
Hi All, As per knowledge, you have to follow some rules & regulation while making owner's association. Like A memorandum with the name of the society, reason for existence of society, names and addresses of the members of the association needs to be registered and signed by a minimum of 5 people. Hi Mr Venu, As per my knowledge, Thoraipakkam-Pallavaram Radial Road, running east to west, connects the IT corridor and the GST Road making Thoraipakkam well connected to the airport, especially after the opening of the flyover (ROB) at the western end of the radial road. This plays a significant role, enabling smooth movement of traffic between the major arterial roads to South of Chennai, including GST Road, Tambaram-Velachery Main Road and Old Mahabalipuram Road.

Hi Mr JAved, As per my knowledge, Padappai, Oragaddam and Sriperumbudur along the NH-4 stretch have been showing fast growth. The last two months have shown a lot of conversions inquiries into actual buying. The biggest investors are NRIs from the Middle East and Singapore.
@ Mr Javed, Buying a plot or apartment depends on individual choices and requirements. But investing in plots does make sense in the long run because appreciation is higher on a plot and they can be used for joint ventures. Plots in peripheral areas are more for a long term investment. They can be leased for storage and small production uses that need open spaces. With additional investments, they can also be leased for warehousing and industrial activities by building sheds.

Dividend distribution tax is the tax levied by the Indian Government on companies according to the dividend paid to a company's investors. As per existing tax provisions, income from dividends is tax free in the hands of the investor. There is a levy of 15% of the dividend declared as distribution tax. This tax is paid out of the profits/reserves of the company declaring the dividend. At a time when the realty sector is struggling for alternative ways of funding, REITs will improve liquidity in the commercial real estate market.

Q: It’s very hard to believe with reviews builders these days, because people say anything without experiencing living in the place. Most of the projects take years to complete and when it’s finally done takes another decade for getting the papers sorted out. I have been living at Featherlite Swargam for a long time. Initially when I booked the apartment, it hardly took any time. And when the construction was done, I was informed on time and given the keys for the apartment without any delay. I feel the project is located a bit interior with small interior access. But it is different to get budget plots in this locality. You can go for this project.

Q: Hi! I had bought an apartment in Asten Viveria at Thengod near Kakkanad. The project was promised to be complete by 2015 and was delayed by the builder. Now i.e. in October 2017, the builder is asking me to take over the apartment for which registration is incomplete, authority water and electricity is not completed and occupancy certificate from local authorities have not been obtained. Is the builder right in his claim to handover apartment without these legal or official documents? Can a aggrieved customer refuse to take over in such instances? Thanks

As per the sources, residential developments having more than three dwelling units or 750 sq.ft would require a Completion Certificate before occupation.
