Builder denying penalty payment for delaying possession
Q: I have purchase a builder flat in sec. 76 noida in resale.Possession of flat is delayed by builder,on asking of penalty mentioned in builder agreement he is denying & told me that in transfer cases penalty is not applicable.

My comments to replies
Hi Manish, As per my knowledge, in resale cases, builder is not the first person(seller). So builder is not reliable to pay you penalty for delaying possession .
Hi Shilpa, What about builder buyer agreement conditions which are transferred to us at the time of resale by first buyer?
