Q: I am a Customer of Subh Grih Project, Boisar. I got a letter from Tata housing, tata housing not giving Possession in Jun-11. Before one Year Tata Housing had sent completion letter, about 70% complete. In Jul-11 Tata Housing had sent completion letter, about 90% Completed. I had submitted completion letter in Bank for next installment. I would like to inform you that I am living on rent. I pay 7,000 Per Month and had paid 18% interest of late payment installment to Tata housing. 18% is too much I have paid fine. Now, Possession being late. So, I need compensation 7000/- Per month. Tata housing Send mail and letter also: reschedule the delivery to November/ December 2011. Now saying, building not completed and not giving possession date also. Before one year Tata housing proudly had told me, Will give Possession before deadline. After getting all payments, not giving possession date. Now Saying Seven month More. Not ready to give compensation. What should I do ?

Hello Chandar, you can join the owners group and get in touch with the other owners of Subh Grih Project and discuss about the issues and problems related to the project.
It would be better without making any more delay file a complain against the builder. This is a clear case of deficiency in service. The affected persons may approach the consumer forum seeking to redress their grievances including claim for damages for physical and mental agony.

Q: Has anybody got the latest update on the project. I don't think the Project is in good state. Everytime I visited the site, new story has been narated to me by the officials for the delays and the new schdule. I think it is time that the owners should have a word with the DB officials. As it seems we all owners have taken things for granted. No doubt today the DB Relaty share price would go down, on fridays news of Etisalte want to proceed with legal action aganist Swan Telecome. Why we owners has to take all these issue on our property, have we thought these things at the time of purchase. I strongly suggest we should come together and meet the officials with deadlines. If we don't do this, I don't think project will complete even by 2015.

Hi all, Are you aware of this new development charges of Rs 1000sq-ft extra. .Every Flat owner has to pay at the time of possession .Project has been delayed because of builder not our fault. Now, the cost has gone up.We were never told about these charges at the time of booking. What should we do now please advice.

Hi Khushisha, I got the Demand Letter for my 14th Slab recently (Bldg No.6) and work is going on in full pace since I received around 10 demand letters in past 6-8 months. We can expect the possession for most of the buildings by Dec 2015.

Hi Daya, I would suggest that pre launch is not good option to invest it just a greed that leads to delay in investment. Hope you take decision wisely. Chk out all the required legal documents before investing in any project. Money once goes will never come back easily.

Q: Please do not buy flats in Gaurav Excellency Mira Road. You are going to get cheated. The builder himself sells the flat to more than one buyers and there are gangs of gundas who comes and tortures you. The area is very bad. Even the investors who have flats in their names sell it to more than one buyers. There are multiple registration for one single flat in most of the flats in Gaurav Excellency. There is a lot of demand in the market which is being held hard by the affordability factor and we are pretty hopeful that the RBI will bring about a good news for interested buyers. At present, home buyers need to pay service tax, VAT as well as stamp duty when purchasing flats. The Government should ensure the quick passage of Goods and Service Tax which will replace numerous taxes and help the consumers.

Right Mani, Currently, taking 10.50% as an average interest rate on housing loan, EMI on admissible loan value of Rs. 6 lakh for a15 year loan duration comes out to be Rs. 6632 for each month. Now with the cabinet approving on the credit linked subsidy to 6.50%, the monthly EMIs come down to Rs. 4050 thereby, offering a saving of Rs. 2582/month.

Yes, The state road development corporation is planning to tap its existing land bank and acquiring more, with the chief minister having given an in-principle signal to appoint the corporation as a special planning agency for certain areas. MSRDC has a land bank of about 500 hectare spread across 24 plots along the Mumbai-Pune Expressway. Of the 24 plots, 3 are in the Panvel taluka, 8 in Khalapur, and 13 in the Maval taluka. If they follow this type of a land acquisition model, about 22.5 % of the developed land could be handed back to the owners and another 25% may be used for development of infrastructure services. Roughly 30% can be made available for commercial exploitation, while the rest will be kept aside for open spaces.

If you compare investment in an apartment in Andheri to an investment in suburbs (Navi Mumbai, Panvel etc.,), which one will give more returns?
Ghodbunder Road in Thane is also good for end users. USP of this region is it’s fast connectivity to the eastern and western sides of city through EEH and WEH . Secondly , residential development has sped up in the past 5 yrs. It has proximity to suburbs and growing industrial and commercial activity. Also , due to the expectancy of getting connected to Mumbai , even more directly, through Mumbai Monorail , in the coming decade , is improving consumer sentiments to invest here .

Hey Devika & Roshini, Good news for Mumbaikers as the city's hunt for more land to decongest and expand has got support from the centre as Union shipping minister Nitin Gadkari promising to hand over 350 acres of land owned by the Mumbai Port Trust to the state government.
Ohh really, That's great move by the Centre. I read that they submitted a proposal to release some part of Mumbai port's land to construct rented accommodation and also affordable housing. And if the land transferred, it would be the 2nd largest transfer for land-deprived Mumbai.

As per the report, Mumbai Port Trust has 1800 acres of land in south and south-central Mumbai along the eastern seafront. But steps to generate income from the land have often been stuck in paperwork for various approvals, and disputes. The port currently earns only Rs.200 crore from its large area of land.

HI Dayananda, The state housing department has now proposed an Engineering Procurement Construction model wherein the MHADA will be the sole implementing agency that will execute the work by appointing contractors.
There is hardly any vacant land left with MHADA in Mumbai. Except for redevelopment of its existing colonies that will generate extra social housing stock, there is no space for construction of affordable houses. If the housing board can take up reconstruction of BDD chawls, it will be able to build additional houses on the land. These can then be released through its annual draw of lots.

Right Chintak, Earlier, the redevelopment of the BDD chawls, stuck for several years over disagreement within the state government on whether to involve private developers or not. The 207 three-storey buildings were constructed by the Bombay Development Department (BDD) under the British government at a meagre cost of Rs 3.5 crore. The 160 sq-ft run-down tenements, with a predominantly Maharashtrian population, are in Worli, Naigaon, Sewri and NM Joshi Marg. Together, these 80-year-old structures occupy 93 acres of prime land in the city.

Q: Some buildings in Navi-Mumbai are given CC with approval of plan, but denied OC due to CRZ-confusion. Even those buildings which can be given CRZ clearance as per new 2011-CRZ-Notification are denied CRZ clearance by MCZMA saying post-facto clearance will not be given as of now. Yesterday's announcement by Maharashtra govt. about regularizing un-authorized buildings in Navi-Mumbai is a surprise, because unitil crz-confusion is cleared how can gaothan & 12.5% buildings be regularized.

It is also came to know that the plan failed to provide sufficient idea and stand for aiding affordable housing that the city requires so desperately. The DP was not clear about whether the densification actions would do any good for housing of low income groups and middle income groups, which form the backbone of residential activity for any Indian city.

If you looks at the past decade, the story of Mumbai's real estate has largely but remained constant. High demand for affordable homes, not enough support in form of restrictive rules and regulations, zoning and permissible FSI norms, excessive time taken for permissions and clearances. So, it seems to me that coming year will be more challenging for Maharashtra Govt for making slum free Mumbai by 2022.

Only god know when is the bill going to pass????? The committee has 13 members who are opposed to, while 11 are in favour of proposed amendments. So, the votes of rest 6 members, who are mostly regional party leaders, matter more. So, they need to pressurise them to protect their rights. I don't understand why are they playing such kind of game in the parliament. Have they ever experience the beggar's life or they ever plough the field in sunny day or they ever harvest the crops? If not.....then how can they say that they are with the farmers? As per Md. Salim Of CPI (M) asked farmers to force their respective MPs to take the right attitude so as to make sure government changes its stand on the bill. According to him farmers will feel cheated, if they rely on Parliamentarians. So, force their respective Parliamentarians to force government to change its approach.

Yes, there were very strong reason for discontinue in the project launches in few cities. In a few markets, developers also stopped from launching new projects as they awaited new development plans for the cities. In Mumbai, for example, the industry is waiting for the proposed Development Plan 2034. Hyderabad bucked the trend with a 200% jump in launches while all other markets ­ such as Mumbai, Delhi-NCR Bengaluru, Pune and Chennai ­seen a drop.

Hey Niraj, Two months ago i visited the developers office and ask for the approval papers and they show me the NOC from CIDCO, NAINA appoval certificates, Collateral approvals, NA plot papers etc. So, i would suggest that these are the sufficient papers for any project. Hello Veena, There are several factors which define the credential of a builders. Every residential and commercial building needs varieties of permission from local and government bodies. Reputed developers will make sure that their projects have all the required certificates and necessary permissions required by the local authorities. A reputed builders will not take the matter so lightly.

Yes, it is true, On buying a home in an under-construction project, the buyer is confident of a certain time-period in which possession will be given. A reputed developers will not mention the possession time-line beyond a logical limit, firstly because they have huge fund and secondly because they will not take any risk putting their credibility on the market.

Hi everybody, I think our Maharashtra Govt. should like CIDCO. They always come with some new initiatives for the real estate sector. Several department have given their own view. As per Marketing Department suggested reforms linked to receipt of Lease premiums and also suggested implementation of extensive software for online receipt of application and lottery for large-scale housing schemes. Whereas, Engineering Department suggest decentralisation of proposal approval processes and better integration of accounts touch points and also informed that the some services like Drainage & water connection, Contractors registrations and Product approval will be online.
As per Accounts department , there should be implementation of online payment gateway for all payments and receipts. Estate Department suggested moving certain services like delay eviction, amalgamation, NOCs for water and electricity connections to be made part of Building permission software. They further suggested that all estate services should be made part of Estate CFC and starting of CFC at Nodal Offices and improvements to process of Mortgage NOC.

Hello Khushisha, The prices will not fall at least in the near future. if you have seen the proposed payment in the DCR 2034 to the BMC, you would see that TDR payment has gone up for builders. Previously it was based on the RR rate of 2008. Now the govt. has announced it should be 60% of RR 2015. This itself increased the project cost by crores. Now according to 2034 DCR, the rates are to be 70-100% of RR of the present year. This will lead the developers to increase the flat cost.
Yes, it is over prices and no, prices ar not coming down. Mumbai's geographical location is enough to tell you why prices are always on the higher side. Even if people buy flats for price appreciation, many of them are rented to folks coming here for jobs. There is a scarcity of houses. You will see usual 3-5% correction and builders are ready to hold inventory for unusually long times because there are buyers for it.

Right Kishore, If DCR 2034 applied then a builder will have to pay more to the BMC than the tenants of a building. As a result, the excess FSI that a builder would get would be used to cover the increase in cost due to this price increase. Base FSI will be 1.5, if allowable FSI is 8, most of the other 6.5 FSI has to be bought from the BMC at the new premium rate. As a result builder will get no advantage and if they would not get any advantages then no way he can pass on any benefit to the buyer.
This is not a new fact. Prices in Mumbai have been unaffordable for years now. Then how are builders building new and expensive flats. Who is buying then? Simple answer, in Mumbai the developers have an unusual talent to control supply if they feels prices are being knocked down. The stop construction activity till a time they get a price that they want. Inventory lies either in finished format or under construction. And this work well when there is a larger group of builders who can not control supply Vs those who sell at lower prices

Good Morning Vishal!!!! There must be some date by which the builder is obliged to give you occupancy certificate. If that date is there, talk about this to your builder. If it is being delayed intentionally without any reason, you send him legal notice. About his interest delaying the occupancy certificate, he may be looking for an opportunity to get additional money in one or other form.
Right Ketal, You cannot occupy the flats in absence of Occupancy Certificate by the Municipal Corporation. It is certificate that proves that building has been completed as per sanctioned plans. You can file RT application with NMMC as to why OC has not been issued for the project

I have booked an apartment with sky forest, I have been informed that I will be given possession of the property in 2018. I am really excited, can’t wait for the handover, and whoever I spoke to told me it is a smart choice to invest in this project as higher appreciation is expected in near future.
Hi Abhay, Yes, even i have a discussion with them. They are giving possession by March 2018. The price is between 7.99 Crores to 12.04 Crores, which is quite expensive. I just wanted to know if there was scope for further appreciation in the area as the flats are already priced a lot.

As HDFC is specialized in Housing Loan and their rate of interest is also lucrative so, i would suggest you to go for HDFC Bank.

Q: Hi what if the developer changes the number of floors in the building I.e someone who has bought 2nd last floor from top and the builder removes the top floor and the 2nd last becomes the top floor. What is the legal remedy for this issue? All this done without informing the buyer.

Hi Usman, It is illegal. As per "Apartment Acts" across the country does not allow layout plans to be changed without the permission of existing home buyers. Recently, Supreme Court also confirmed that a developer can not make modifications in the layout plan and floor plan without the consent of existing residents. However, most of the developers are still violating these laws. They have been adding extra towers by reducing the common areas of societies. You can take legal step for that.Hi Usman, It is illegal. @Jagraav, Even they served a sen-days notice period to the building. This happened more than once since December 31, when they were scheduled to start the demolition. Now, they are unsure when to start the demolition.

At the same time, this bill will have a positive impact on the Indian economy as it would provide confidence to foreign investors. As far as responsibility for delay is concerned, it lies both with the developer and the Government authorities. Thus, if we look at the larger picture, the delays in execution also have a negative bearing on India's GDP.
So, it becomes necessary that a global standard is maintained and transactions are monitored by a regulator. Secondly, the escrow account will help in controlling redirection and misuse of funds, ruling out unsafe practices.

Q: I am planning to invest in New panvel area for period of 4-5 years expecting good returns after that. One of the reputed builder from area Neel Group has good project just behind DMart but asking price for 2BHK is 1.15 crore. Is this price fair? Right Shalini, The New Panvel locality is more developed than the old one as it is being developed, administered and maintained by the CIDCO. Since more land is available in Panvel (as compared to Navi Mumbai) real estate developers are exploiting this plus point and providing better amenities at the picturesque backdrop of hills. Due to the JNPT establishment, the largest IT parks at Mahape, small and large scale industries in local MIDCs and developments at Lonavala and Hinjewadi on Pune side generated huge employment opportunities at Panvel.
Right Abhishek, Infrastructure and income generation are the two most important factors attracting investment in real estate at any particular destination. Though there are other major infrastructural projects such as Mumbai Trans-Harbour Link, metro and elevated Chhatrapati Shivaji Terminus (CST)-Panvel Railway Corridor proposed in Navi Mumbai, the international airport has added a thrust in Mumbai developers’ wings to expand their reach in the twin city. The real estate industry was hit hard in 2015 by poor sales of residential projects and fewer launches, resulting in a surge in unsold inventory. While the sales volume during 2015 was similar to that in 2014, new launches fell sharply by 21% across the country, Knight Frank said in the 4th edition of its half-yearly report – India Real Estate. Last year the sales volume stood at 2.64 lakh units, while in 2014 it was 2.74 lakh. In terms of new launches, NCR, Mumbai and Bengaluru witnessed a sharp drop of 20%, 36% and 27% respectively during 2015.

Sales in this sector are not likely to see any significant recovery during January-June 2016.

Hi folks, Mumbai's real estate sector has recorded the lowest number of new launches in the first half of 2015 since the realty slowdown began in 2008. Add to it the fact that there are around two lakh unsold homes and slowing sales, and what this means is that there will be no recovery in the housing market for at least another 6-months. As per report, January-June 2015 the number of new launches in the Mumbai Metropolitan Region declined by 47%, 18887 units compared to 35512 units launched in the same period last year.
Yes, and it is considered as the worst hit is the luxury residential market. Not a single residential project priced at more than Rs 5 lakh has been launched in the first half of the current year.

Hi Swapnil, Did you talk to the builders? What are they saying? I heard by some reliable sources that they are waiting for the Commencement Certificate. As we know that CC is a required document to start the construction works. Apart from that NOC from pollution control dept and fir fighter dept is also necessary.
Yes, Mr. Manish. I think buyers should visit the site once and developer's office to know the ground reality. They can also create a FB Group and update it as they received any information on it. Try to pressurize the builder for starting the construction. If the builder is unable to deliver the project on time he is liable to pay you the compensation along with the interest.

Hi Devang!!! Here is a list of problems we faced/ or probably you would face too with DB Realty if you are deciding to book a house. 1) They will never let you read the agreement while signing, 2) Once booked you will not get any status updates, 3) You can't sell your flat even after the lock in period, you will have to bear a unnecessary transfer charge which will shave of nearly 30% of your profit, 4) agreements will be one sided which will favor the builder only, there is nothing in favour of the buyer, 5) Every payment delayed by even a day would lead to a huge penalty by 18%, 6) Layouts and plans can be altered as per their convenience.
Yes, we all are facing the same issue Devang. Don't go for this project or your hard earned money will stuck. Even after the builder has crossed his delivery deadline as per his own agreement he can continue to delay, it stating unavailability of materials etc. Now we are out of options so decided to put this up on social media. Hoping that one day we will get possession for our houses.

There is another project by Spenta Corporation in Andheri called Palazzio. This project is spread over 2 acres of land, comprising of six towers- each of 12 storeys each. Hi, I am agree with all my friends. First of all you should get the deposit amount in full without any deduction hen only you can even think of the interest portion. I am not sure about which scheme to go for in GB road as bigger names have a high premium like the Lodha Amara 1bhk would go beyong 75L.

Yes, a builder can not advertise and sell their flat before RERA Registration. If Your project is under construction then builder has to take the approval from the concerned department for sale their respective units. Q: I purchases a flat in 2013 and was given an allottment letter without any possession date. I wanted to register the property but within three months builder stopped work completely. even after 4 years the project is less than 15% complete. I want refund but builder says he will pay in installments over the next 4 years with 10 percent deduction. in worse scenario dont mind the deduction but i want the builder to give me back my refund in one go so that i can invest elsewhere which he is refusing. Can i approach rera on the basis of allottment letter. please share your inputs

Hi Padma, Once occupancy certificate is issued for a project, no GST is applicable on it. It is similar to previous laws of vat and service tax where vat and service tax were not to be charged after receipt of Occupancy Certificate.
