Hi, I have paid for a flat at Sunny Fort Newtown and was promised a handover in 2010. They have delayed it by 5 years now. Please let me know if I could pool into filing a lawsuit against them. Also accept my request on FB group. -Harprit

Also, you can consult a reputed lawyer to know about the legal aspects of the order and what is mentioned in your property agreement and with the help of your lawyer suggestion you can file a case against this matter Thanks.

HI, It is mandatory to pay stamp duty as per the stamp duty valuation fixed by the Registrar of your area under the stamp duty act of your state. Currently, Stamp Duty in Orrisa is 7% and Registration Charges are over & above Stamp Duty and is levied @ 1% of Total Property Value as per sale deed.

Hi Sasmita, Stamp duty is payable on market value or agreement value whichever is higher. Stamp duty must be paid at the time of execution of the agreement. Penalty for late payment of the stamp duty is 2% per month on deficit stamp duty amount, subject to maximum two times of the deficit stamp duty amount. Current rate of Stamp Duty is 7% and Registration fees is 1 % of the market value or agreement value whichever is higher. There is also VAT (Sales Tax) applicable at 1% of agreement.

While they form a common municipality both the places are also identified individually. The worst part here is the traffic departments have asked the terminal authority to put up a couple of traffic signals in the area to stop this from happening. But the teminal authority have not responded to this. Well Biman, The refusal can be broadly classified into two categories - refusal of acceptance of documents and refusal of duly presented document. A document brought for registration shall not be accepted under the following circumstances:- 1) If it contains unattested interlineations, blanks, erasures or alterations which in the opinion of the registering officer, require to be attested or entered in a "Kaifiyat" at the foot of the document. 2) If the description of the property is insufficient to identify it. 3) If the document is unaccompanied by a copy or copies of any map or plan which it contains. 4) If the date of execution is not stated in the document etc.

Thank You everyone for replies above. My scenario is : Investors has bought the flats in the society and have done just a sale agreement with the builder and the flat is lying vacant unused. Even the water /electricity / and all other fittings are not done. The property is not registered in the name of the seller. I mean the property is not at all registered. But we have to pay the money to the investor. There is man who has the keys of all such resale flats, who showed us and we selceted one and want to buy it. This middle man says come and book the flat by paying 1 lakh booking amout. But before that , i want to get it clear that I am not being cheated. As I have never met with builder or the seller. So please guide me that what all documents should I verify before going ahead.
Hi Asha, list of documents required to verify before buying resale property: 1. sale deed in present seller’s name 2. Khata certificate & extract 3. Latest tax paid receipt 4. If any loan outstanding on the property, latest statement from bank 5. Encumbrance Certificate from date of purchase till date 6. Agreement of sale & construction executed by developer in favour of seller 7.Latest electricity bill & receipt for the that flat.

The will provide you developed villa. And the price will be Rs.32.30 lakf for 1.5 cottah villa and Rs.35.32 lakh for 2 cottah villa. Yes, the sample flats are ready. Well Rajarshi, Booking amount will be Rs.3 lacs for 2 cottah and Rs.2 laks for 1.5 cottah. As far as electricity and water is concerned, WBSEB are the electricity provider and deep tube well water is available as well Kolkata Mahanagar Palika is providing water for this project. Almost all the leading banks and financial institutions are funding this project.

I live very close to Magnolia Mint and have been watching the progress..project is recently launched, but many people are coming to visit the site, I think 40% of total float is sold out in the past few days of launch. As per builder executive, the project is expected to complete till Dec 2018.

Hello, I would like to add my experience in home loan, I have opt for floating interested rate for my home loan. In case of a floating rate loan, the rate of interest varies with the market situations. This type of home loans is linked to the base rate of the financial institution, plus a floating element to it. So, if the base rate varies the floating interest rate also varies.

@ Das, Short-term capital gains are gain which is applicable if you sell your property within three years of property purchase. Lets us take a simple example to understand short terms capital gains, if you are selling the property for Rs. 15,00,000, the short-term capital gains will be 30 per cent on the amount or Rs. 4,50,000.

Hi Anish, I think you should google it out and definitely you get the calculator to solve your problem. Long term capital gain arising on account of transfer of long-term capital asset will be computed as follows: Sales consideration of property minus Expenditure incurred wholly and exclusively in connection with the transfer of the capital asset (E.g., brokerage, commission, advertisement expenses, etc = Net selling cost of the property. You have to also deduct any cost of acquisition and improvement cost.

Q: I am planning to take a flat in siddha town. The only thing that I am bothered about is the location of the complex. As i don't have a private vehicle can anyone suggest me about the auto service that goes from rajarhat to airport. Will I be able to get an auto from the complex to aiport during office hours in the morning or it will be full from rajarhat? Moreover till what time at night will I be able to get auto from airport?

And Via Rajarhat Road, it is 5.0 kms and can take 16 mins in traffic and 13 mins without traffic. HI Rajiv, Every city has has its own advantages and disadvantages and if you take kolkata's politics as a negative then i would like to say that Kolkata is very safe and cheap city in terms of Mafia Raaj and economically too. Secondly, located on the outskirts of Kolkata and is a fast growing satellite city planned by the West Bengal government. Consisting of two villages, Rajarhat and Bhangar, this area is being developed in the north eastern parts of Kolkata. This is about three times the size of Salt Lake and is home to many IT companies. Corporates have purchased land in this area with plans of developing them at a later date. Q: I have purchased a flat in Kasba under Kolkata Municipal Corporation, and already made 50% payment. But the builder is saying he cannot give completion certificate. Now he is threatening to cancel the agreement and selling the flat to someone else. What to do? Please advise

HI, It is mandatory to pay stamp duty as per the stamp duty valuation fixed by the Registrar of your area under the stamp duty act of your state. Q: Very recently in the West Bengal state budget a bill was passed wherein Stamp Duty payable at the time of execution of Agreement for Sale would be 2% and the balance Stamp Duty of 5% along with Court fees will be payable at the time of execution of Deed of Conveyance. Now, if an investor buys a property and pays 2% stamp duty upfront and then sells it to a third party before completion of the project what will be the implications of the recent amendments. As in what will be the liability of the Stamp Duty on the 3rd party at the time of execution of the Deed of Conveyance?

No, they have clearly mentioned that in order to get the benefit of the reduced rate, the registration has to be done within 4 years from the date of agreement on payment of balance stamp duty.
