Madras High Court has ordered government to amend City Planning Act
The Madras High Court on Monday gave six weeks’ time to the State government to amend the Tamil Nadu Town and Country Planning Act for dealing with illegal constructions.
The government has conveyed to the court its intention to amend various sections of the Act, relating to effective enforcement action and for providing solution to unauthorized developments made in all real estate projects in Chennai and all other areas of the state.
The government also stated that a draft bill had been prepared by the Law Department for carrying out certain amendments to the Tamil Nadu Town and Country Planning Act 1971.
It is also mentioned by the government representative that the amendments will be placed before the Legislative Assembly during the winter session and hence six months’ time may be required for the proposed amendments to be brought into force.
The high court said that if there is delay in placing the Bill before the Assembly, the government may come with an ordinance.
