
A wall was erected in June 2012 between leasehold land owned by Tehnaz Master and leasehold lands which blocked access to another freehold land that belongs to Tehnaz. Master allege the court to direct demolition of the wall but no action was taken against the illegal wall by the civic bodies.
The BMC advocate submitted that Mhada had constructed the wall at the instance of a local MLA using the MLA funds. Justice Khanwilkar said that whether it is performed at the instance of the MLA, prior concur on the BMC is required.
The high court ordered the Brihanmumbai Municipal Corporation (BMC) to issue a bulldozing or a stop-work notice to the Maharashtra Housing and Area Development Authority (Mhada) if the company does not get permission to construct a wall on a private property of SV Road, Andheri West.
