GHMC confused over urgency clause of LA act

GHMCHyderabad-  The Greater Hyderabad Municipal Corporation’s (GHMC) two wings namely town planning unit and land acquisition unit are struggling over the ‘urgency clause’ of the Land Acquisition (LA) Act.

According to the urgency clause of Land acquisition act, property owners do not have any right to raise objections over acquisition of their properties.

On one hand, the town planning (TP) unit wants to invoke this clause to acquire 68 properties for the proposed Tolichowki flyover while on the other hand, the land acquisition (LA) unit wants to take over properties following due procedures. 

In December 2012, the Greater Hyderabad Municipal Corporation proposed the construction of 650 metre flyover at Tolichowki to ease traffic between Mehdipatnam and Gachibowli. It is a split flyover which will be constructed with an estimated cost of Rs 32 crore. The flyover would split at religious structures (temple and a chilla) located at the middle of the road and then would merge after it.

The civic body has been invoking this clause in urgent situations to acquire properties to finish various projects and road expansion in the city. A notification followed by a month’s time is given to the property owner to raise objections forms a normal procedure. But the corporation takes advantage of this clause and acquire properties for flyovers and even in routine road-widening works.

The land acquisition wing was recently asked to take over 68 properties for constructing Tolichowki flyover immediately by using the urgency clause of the act. The LA unit declined the proposal of civic authorities keeping in the view the necessity declared by the state court to invoke the urgency clause of the act.

The GHMC land acquisition member cleared that the acquisition of properties for Tolichowki flyover would be taken up under normal procedure in any condition. The landowners would be given enough time to raise their objections.

The construction of this flyover involves land acquisition and road widening works. For this purpose, the existing roads of 100 ft need to be widened to 150 ft and the proposals of 43 properties have already been sent with remaining 30 proposals to be sent soon.

The tender process is completed and the proposal of M/s M Venkat Rao Infra Projects Pvt Ltd is likely to be approved by the state government. The company proposed three percent more than the estimated cost of the flyover. Thus, the tender also need to be cleared by Municipal Administration and Urban Development (MA&UD) department.
