SHIFTING OF AMMO DUMP AT GURGAON, FARIDABAD

The nine-member committee constituted by the cabinet secretary of the Punjab and Haryana High Court articulated displeasure with looking for shifting of the grenades dump at Gurgaon and Faridabad.

As per the division bench of Chief Justice Sanjay Kishan Kaul and Justice Arun Palli the committee should be made in the name of Municipal Commissioner Praveen Kumar’s, directing the reconstitution of the committee.

The details of the committee constituted by the Cabinet Secretary has been placed before the bench for counsel for the Union of India Onkar Singh Batalvi as the case came up for hearing again.

The committee was to be headed by an Additional Secretary in the Ministry of Defence stated by Batalvi to the court. Two members were to be taken from the Department of Research and Development and another from the Defence Estate. Few other members will be from the Department of Atomic Energy and the Union Ministry of Urban Development.

The Bench was of the scrutiny that the defence, with five members, had more than the obligatory representation.  There were questions from the bench for the foundation behind appointing the Chairman of the Ministry of Defence and the Cabinet Secretary’s move to consult the Defence Ministry. It was in consideration by the bench that in any case nine members were more than the requirement.

The Bench was also decisive of appointing a Secretary-level officer from Haryana and the reason behind it was the officer should be well conversant with the area. The Bench recommended Praveen Kumar’s name as they felt that the senior IAS officer will be well-versed with the ground realities and the topography of the area.

After a PIL was filed by Suresh Goyal of Faridabad the matter reached the High Court. As the 100-meter around the Air Force Station, Dabua, in Faridabad was a protected zone under the Work of Defence Act therefore they were looking for the removal of constructions. The High Court had also taken into consideration a similar matter on the construction activities within the restricted 900-meter zone in Gurgaon.
