DDA asked to pay Rs 30L or provide flat to its allottee
New-Delhi- A state consumer commission has directed the Delhi Development Authority (DDA) to either provide a flat or pay Rs. 30 lakh to one of its allottees, as the unit allotted to him has been sold to someone else.
However, it was stated by the Delhi State Consumer Commission that the confirmation amount demanded by the DDA from the allottee was untrue and that the demand related to the flat was ‘non-existent’.
It is also believed that there has been default in the performance of the contract by respondent (DDA) and that they are supposed to pay back the received amount which can be used to provide another flat for him or pay him the money.
As per a bench member, if there are no flats available, the DDA will be liable to pay the person Rs. 30 lakh due to the increased prices of properties in Delhi. The deadline to either provide the person with a flat or money will be within 30 days despite the availability or non-availability of the flat. There will be a date of receipt of this order.
The state consumer commission also asked the DDA to refund an amount of Rs. 30,000 towards booking and confirmation from the Delhi resident.
This order came when the complaint filed by the Delhi resident was dismissed and an order was issued against it stating that the person was not entitled to a flat as he has not paid the remaining amount of Rs. 4,33,059 within the given time.
As per the resident, he had applied for the flat in the year 1996 under a housing scheme floated by the DDA. He was allotted with a flat after he made a payment of Rs. 30,000 while booking and confirming as per he authority. He also stated that he was given time till June 2000 to give the remaining money but later discovered that his flat had been given to someone else in 1996 when he filed an RTI application to enquire about the status of his flat.
On the other hand, the DDA alleged that due to the non payment of the remaining amount, the allotment was canceled.
