HC asked BBMP Bangalore to furnish complete list of encroachments on Drains

HC: Not to discriminate while demolishing the encroachments/unauthorized constructions.

The Karnataka high court on Tuesday asked BBMP Bangalore not to discriminate while demolishing the encroachments/unauthorized constructions. It further observed that no notice is necessary in clearing/removing such encroachments.

The bench directed BBMP to furnish through an affidavit by August 4 the complete list of encroachments/unauthorized constructions on storm water drains (SWDs) and rajakaluves (canals) in and around Bangalore.

“You have to tell us how many such unauthorized constructions are there, how many are cleared and the proposed plan of action in respect of others. If you furnish these along with the procedure, then we will be able to pass an order to help you. It must be done,” a division bench headed by chief justice J S Khehar observed while hearing a PIL filed by five year law course advocates association.

Advocate general Ashok Haranahalli who appeared on behalf of BBMP said that so far they had identified 400 such encroachments in and around Bangalore and demolished 271 such buildings/constructions. He said they have to identify encroachments before initiating further action and in this regard the city had been bifurcated into eight zones and officers have been entrusted with the task.
