Mumbai: BMC tells SC out-of-court settlement “not possible” in Campa Cola dispute
With regard to the proposed demolition of 96 flats constructed illegally in the Campa Cola compound in Mumbai, the Brihanmumbai Municipal Corporation (BMC) told the Supreme Court on Monday that an out-of-court settlement of the dispute was “not possible.”
In response to the query by a bench led by Justice S J Mukhopadhaya about the likelihood of an out-of-court settlement in the long-standing Campa Cola row, the BMC said that all the possibilities of such a settlement had exhausted.
However, the bench also asked the BMC whether the civic body was evicting residents of the illegally built flats in the Campa Cola compound and proceeding with the demolition of the complex under the pretext of the court order.
The bench emphatically stated that the legality of the construction of the flats in the Campa Cola compound had been adjudicated upon by the BMC itself, and not by the court. As such, it was inappropriate on the part of the civic body to give an impression that the flats had been deemed illegal by the court.
In addition, the bench also said that, if the residents of the Campa Cola compound want to seek clarification on whether or not their eviction and the demolition of the compound had been ordered the court, they can move an application to the bench to get the matter clarified.
