Action to be taken against Unauthorized Firms in Sadashivnagar

Sadashivnagar has about 130 commercial buildings.The residents’ welfare association had filed a petition stating that residential properties were being used to house commercial establishments. The High Court on Tuesday has directed the Bruhat Bangalore Mahanagara Palike (BBMP) to take action within eight weeks against unauthorized establishments in Sadashivnagar and the RMV Extension, where residential properties were being used for commercial purposes. The High Court has instructed that action taken be completed within three months.

The roads constructed for catering to the vehicular traffic of a residential area are being choked. The vehicles are being parked in a haphazard manner, creating chaos and inconvenience to residents. The counsel for BBMP, KN Puttegowda, has assured the court that action will be initiated in eight weeks against the unauthorized firms, and all such unauthorized commercial activity would be halted in three months.

The division bench headed by chief justice JS Khehar observed that the status report filed by the BBMP suggested three categories of commercial spaces: first, persons using residential buildings for commercial purpose, but have obtained authorisation for such activity. No action need be taken in such cases. Second, people who have converted residential to commercial as per the revised master plan. No action is called for in such cases either.

Third, residential properties that are being put to commercial use, even though the revised master plan shows these areas as residential ones. This commercial activity is thus being conducted from an unauthorized space. The bench has sought that the BBMP also recover damages from those found to be violating the norms by operating commercial establishments in these areas.
