Ansal properties to pay the penalty for exercising unfair trade practices

Again in another hearing by the District Consumer Disputes Redressal Forum, the builders were found guilty. The District Consumer Disputes Redressal Forum has directed Ansal Properties and Infrastructure Limited to pay Rs 50,000 as compensation to a New Delhi resident.

Sudhir Khosla the complainant alleged that in 2006, he had applied for a residential plot with the Ansal Properties. He was promised that he will get the residential plot in the nearby area of Delhi. However Without his consent, in June 2011, he was allegedly allotted a plot in Golf Links II, Sector 116, SAS Nagar.Khosla had paid a sum of Rs.6.25 lakh for the plot.

the consumer forum on complaint of Sudhir Khosla,also directed the real estate company to refund Rs 6.25 lakh paid as advance while applying for a plot along with 7 % interest.The developer will also have to pay Rs 10,000 as cost of litigation.

However Ansals have rubbished all the allegations. Ansal properties denied any deficiency in services. The real estate firm claimed that Khosla was not a consumer as he had nowhere stated that he had availed the services for his own use. However the forum gave the verdict in favour of Khosla and mentioned that the refusal to refund the amount with 7 % interest as per stipulated conditions in the advance registration form is definitely a case of deficiency in service. This also falls under unfair trade practice.
