Apartment owners in Hyderabad to receive regularisation charges
Hyderabad- Three realtors and Sri Krishna Abhyudaya Constructions firm have been charged to pay Rs 1.64 lakh regularisation charges and Rs 10,000 for selling unauthorised constructed flats to nine flat owners of Ramanthapur.
A case was filed against the builder of the apartment in Hyderabad and realtors in the year 2011. The case was filed by nine flat owners of Sai Annapurna Residency in Sharda Nagar, Ramantapur. They registered a complaint at Rangareddy District Consumers Forum.
The petitioners alleged that the builders initially got approval from Greater Hyderabad Municipal Corporation (GHMC) to construct the building with ground plus two apartments in a given area of 679.87 square yard land. But they actually constructed ground plus three individual houses and additionally a penthouse at third floor. After this illegal construction they also constructed a shop for which they did not obtained any approval for cellar.
These nine flat owners purchased and settled in the apartment complex between 2005 and 2007. After some time, the builders demanded owners to pay regularization charges of worth Rs 1.64 lakh. Further they warned the owners that failure of paying these charges may result in removal of whole building by GHMC. Owners were worried over this and they were forced to pay the regularization charges. This is how the entire building along with the illegal penthouse got regularised.
The petitioners pointed out the problem of water seepage and excess usage of electricity caused by the builders. They told that this problem raised due to the destruction caused to the overhead tank during construction of illegal penthouse.
The forum heard the arguments of both the parties and concluded that all realtors and the construction firm will reimburse Rs 1.6 lakh to the flat owners which was given for regularisation. Additionally an amount of Rs 10,000 was also demanded by forum as legal costs to the flat owners. The builders were also directed to spend money on the repair of overhead tank. All these order must be completed within one month from the date of hearing (28 Jan).
If the flat owners need to demolish the illegal structures of the building, then they will have to file a civil suit.
