Bhubaneswar Development Authority unable to control Panchayats
The Orissa Development Authorities Act, 1982 cannot be implemented to rural areas.
In a judgment, the High court said that bringing 205 villages under the BDA planned area would take away the power, duties, functions and authority of gram panchayats by the development authority.
In the order the high court restricts the power of the authority only to urban areas in Bhubaneswar, Jatni and Khurda.
According to the developers association, right now there is no specific statement regarding the clearance procedure of the housing projects in the rural areas of the state.
With the court order the BDA has no jurisdiction over the panchayat areas.
