Builder to pay Rs 2 lakh as compensation
A builder was asked to pay compensation of Rs 2 lakh to a couple by the Maharashtra State Consumer Commission for cancelling a booking of a flat.
The builder cancelled the booking when the Thane based couple denied to pay Rs 1,000 per square feet which is more than the booking rate.
The couple booked a 1,200 sq ft flat at a developer’s Mulund project for Rs 59.35 lakh in March 2009. After two months, the developer completed the agreement work . The couple paid Rs 1 lakh and ask for the NOC from the builder for a loan of Rs 50 lakhs from SBI bank, two days after the completion of the agreement work.
A week later, the developer issued a notice saying that the couple has to pay an amount of Rs 17.2 lakh within 15 days, or give extra money. After that the developers cancelled the booking.
The developer verbally fought that they were fair enough in demanding extra money as price changes and the couples defaulted in payment. The consumer commission dismiss the case saying that the developer forced the couple to pay extra amount, in violation of the agreement’s condition.
