Builders say they can’t give parking space for free

The Sept 1 Supreme Court ruling prohibits builders from selling parking area as independent units to flat buyers. A division bench of Supreme Court has ruled that builders cannot sell parking areas in the stilt area as independent units as the same is to be extended as ‘common areas and facilities’ for the owners. Builders, however, say they can’t give parking space for free. So, if the ruling is implemented strictly, they will have to hike the construction cost or collect the same in the name of development charge for creating common facilities.

Majority of the city builders seem unaffected by the September 1 Supreme Court ruling, which prohibits them from selling parking area as independent units to flat buyers. Unscrupulous builders seem to have found ways to get around the apex court decision. While the SC ruling stops builder from selling the parking space, the same is sold under the name of allotment or parking deposit or rights.

In residential schemes, builders often eat away the open spaces shown in the initial plan and sell them as allotted parking. The ramp to basement parking is often built with a wrongly-designed gradient and the space is cluttered with many pillars leaving no space to park as it helps builder save overall construction cost.
