Check for Completion Certificate by ADA before buying Flats

Before buying any property the buyers should verify whether the owner of the building possesses a completion certificate duly issued by Allahabad Development Authority (ADA) or not.The certificate is issued within 90 days of receiving the application and in case of refusal, the concerned party has the right to apply for review within six weeks.

What is a completion certificate? Every building owner after completing construction has to submit an application for the same attaching the map of the building/house along with an undertaking signed by the owner and concerned architect/site engineer stating that the building has been constructed in accordance with the sanctioned plan and in accordance with the given quality and specifications mentioned in National Building Code and is fit for use. After verifying these claims, a completion certificate is issued by the ADA.

The above guidelines are applicable for four-storeyed buildings and above or whose height is 15 m and above, apart from educational buildings, assembly halls and others whose covered area is 500 m and above.

Recently, cases had come up where private builders and colonisers had undertaken construction of multi-storeyed residential apartments without following set norms. This later caused much inconvenience and loss for the customers, who had already registered a flat. The ADA, thus, aims to make the buyers aware of norms supposed to be followed by builders, so as not to invite action against the properties constructed by them.

In case any building/apartment owner fails to apply for the above certificate, and proceeds with use/sale-purchase of the building, the said premises can be sealed under the provisions of section 28(k) of the UP Urban Planning and development Act, 1973. The same rules are applicable in the case of group housing schemes.Besides this, sale of common area and undertaking construction against the sanctioned map would invite a penalty of Rs 3 lakh to Rs 5 lakh and imprisonment of 3 to 6 years or both under section 25 of the UP Apartment Act.
