Conversion of plots not to attract service tax

The Commissioner, Customs and Central Excise Department has ruled that the conversion of plots will not attract service tax. This has come as a relief to the plot holders in Industrial Area, Phase I, and Phase II in Chandigarh. The order applies to the conversion from industrial to commercial.

UT Estate Office was issued a show-cause notice for the service tax in July 2013 for not depositing service tax. Tax amounting to Rs. 24.34 crore was also waived by the commissioner. The UT Estate Office had asked the plot owners to pay service tax or face cancellation of allotment of their properties, after receiving the notice in September 2013. The notice was challenged and appealed before Commissioner by the plot owners.
