DDA to allow property conversion via general power of attorney, registered agreement

In a recent statement, the Delhi Development Authority (DDA) has revealed that it has reached a decision with regard to allowing the conversion of property – from leasehold to freehold – through general power of attorney and registered agreement to sell.

The move announced by DDA is noteworthy because an earlier ruling by the Supreme Court had – in a case dated back to 2011 – suspended such a conversion of property from leasehold to freehold.

About the decision to allow property conversion on the basis of general power of attorney and registered agreement to sell, DDA said in its statement: “The Competent Authority in Delhi Development Authority (DDA), after taking the opinion of Solicitor General, has decided to allow such conversions subject to producing documents authenticating that the transaction is genuine.”

The authenticity of the documents will be verified when the property-conversion application is processed; and the conversion will be subject to production of related documents like agreement to sell registered with sub-registrar of Delhi.

DDA also said in its statement that once the requisite documents have been duly verified, the Authority’s Land Disposal Wing and Housing Wing – which comprise the lease administrating agencies of DDA – will advance with the process of the property-conversion applications, provided that of all other codal formalities as laid in conversion brochure have been completed.
