Deed of apartments to be executed by landowners
The Delhi high court has allowed the Capital’s land-owning agencies to execute “deeds of apartment” for home buyers in case a builder fails to do so.
Allowing a PIL which sought a direction for enforcement of the Delhi Apartment Ownership Act, a bench of Acting Chief Justice A K Sikri and Justice Rajiv Sahai Endlaw said in case the builders of the apartments failed to execute the Deed of Apartments, the competent authority of the agencies is empowered to do so.
As per the PIL, nothing has been done resulting buyer’s failure to obtain absolute ownership of the flats, facing difficulty from builders.
Allowing this, the buyers can have exclusive right over their houses and need not to depend on the promoter to transfer the property, said the Delhi high court.
