Delay to deliver properties on time may have dire consequences on the builders
This issue is faced by most of the property buyers in metros. The builders most of the times fail to deliver the property on time and the buyer has to pay the rent as well the EMI which truly increases his/her financial burden. Hence kudos to Bhupati Shukla who filed a case against Ozone Shelters (the developer) with the Bangalore Consumer Disputes Redressal Forum when the builder failed to handover the flat on time.
The District Forum ordered Ozone Shelters to pay around Rs 4.4 lakh as compensation to Shukla for delayed delivery of the flat and Rs 81,600 for reduction in the undivided share of land. The District Forum held Ozone Shelters (the builder) guilty of deficiency in service, and also ordered them to pay Rs 35,000 towards legal costs incurred and as compensation for the mental agony caused.
Bhupati bought a flat in Ozone Evergreens in October 2009 for around ₹30 lakh. Later, the builder decided to make some modifications to the flat. The builder was supposed to complete the construction on or before May 2011 and deliver the possession. But the sale deed was finally executed in May 2013 and the possession was handed over in June 2013. Moreover, the builder refused to pay the penalty as agreed to, alleging that since Bhupati had delayed one of the payments for the flat he was not eligible for any compensation. However the builder could not prove this during the case in the Bangalore Consumer Disputes Redressal Forum.
The builder has decided to appeal to the Karnataka State Consumer Disputes Redressal Commission.
