Developers stand against Haryana’s draft realty Bill

Real estate developers oppose draft BillChandigarh- Real estate developers of Haryana seem to be having issues with the Haryana government’s plan of constituting a real estate regulatory authority. They have requested time from the government for expressing their objections and opinions on the Haryana Real Estate (Regulation and Development Bill), 2013.

The  Haryana Town and Country Planning Department has prepared the draft bill for the establishment of the authority for regulation and planned development of the real estate sector, to ensure transparency in the sale of immovable properties, and protect the interests of consumers in the sector. The bill seeks establishment of an appellate tribunal,  Haryana Real Estate Regulatory Authority (HRERA), to adjudicate disputes and hear appeals from decisions or orders of the authority.

It was earlier planned that the draft realty Bill will be tabled and passed in the assembly during the budget session. But now the plan has been cancelled. The Bill has already been uploaded the draft Bill on the department’s website for inviting suggestions.

Several realtors met Chief Minister Bhupinder Singh Hooda and concerned officials and expressed their views on the draft bill. Developers including representatives of DLF Limited, Ansals, IREO, Emaar MGF, Vatika, ATS and Anant Raj Group have sought time till March 15 to study and examine the draft bill.

Principal secretary of town and country planning department said that as all stakeholders have sought time to articulate their opinions, the draft bill will not be presented in the House during the ongoing assembly session.

As per sources, a principal secretary-rank officer, close to the chief minister who is near to retirement, is likely to be appointed as the chairperson of the HRERA. According to the draft bill, the chairperson or members of the authority will hold office for five years or until they attain the age of 65, whichever is earlier.

The principal secretary alleged that most of the developers had not carefully gone through the draft legislation. They are anxious about the criminal action under the proposed legislation whereas the draft bill has provisions for financial penalties only. The developers wanted the Haryana Urban Development Authority (HUDA) and Haryana State Industrial and Infrastructure Development Corporation (HSIIDC) to be brought under the ambit of the Bill. However these organisations are duly covered under the proposed legislation.

Meanwhile, the developers claimed that there were certain overlapping and aberrations in the draft bill that should be corrected.
