DGCOM’s complaint against DLF gets rejected
A complaint filed by DGCOM Buyers and Owners Association against Delhi-based leading realtor DLF, alleging market power exploitation, has been declined by the Competition Commission of India (CCI).
The Chennai-based association had filed a petition with CCI claiming that DLF has misused its dominant market position relating to a residential project in Chennai. The petition was filed against DLF Ltd, New Delhi, and DLF Southern Homes Pvt. Ltd., Chennai.
However, the CCI rejected the complaint since there was no prima facie (authentic) evidence to prove that DLF has abused its market position.
The residential project, developed by DLF Southern Homes Pvt. Ltd., to which the complaint is related to, is situated on the Old Mahabalipuram Road, IT Express Corridor, Chennai.
The CCI dismissed the petition, on November 27, and said proceedings had been closed under Section 26(2) of the (Competition) Act, under which the regulator can close a case if it lacks any authentic evidence to progress further.
In their appeal, the association had stated that DLF forced the allottees to sign an agreement which had very abusive clauses, after 18 months from booking flats and after crores of rupees were paid to the developer.
The DGCOM association had also indicated that, there were many other builders in the OMR IT corridor who had launched similar projects.
