Fine to regularize construction based on the total construction cost

The Pune Municipal Corporation’s (PMC) general body approved proposal to impose a fine to regularize constructions as per the Maharashtra Regional and Town Planning (MRTP) Act, 1966. The PMC Pune has approved to impose a fine according to the total construction cost of the building.

According to the approved proposal, to regularize one illegal residential tenement in use without a completion certificate, the owners will now have to pay a fine of 20 per cent of the total construction cost. To regularize illegal constructions built without permission, the fine will be 50 per cent of the construction cost for residential buildings and 70 per cent for commercial buildings.

The original proposal, tabled by former municipal commissioner Mahesh Zagade, had stated that the fine should be imposed based on the total cost of the construction according to the ready reckoner rate. The proposal was later amended to impose a fine according to the total construction cost of the building, and this had come before the GB for final approval.

Shiv Sena leader in the PMC, Sham Deshpande slammed the parties who supported the amended proposal, stating they were indirectly encouraging illegal construction in the city. Ten Shiv Sena corporators voted against the amended proposal, while NCP, Congress party, Bharatiya Janata Party and Maharashtra Navnirman Sena corporators voted for the proposal. “They have displayed double standards as the proposal they have approved is not consistent with their stand to curb illegal constructions. Why not impose a heavy fine for those taking the wrong route,” Deshpande said.

Congress leader Aba Bagul said that it was a wrong perception that illegal construction was being supported. “We have imposed a practical fine. For example, if the fine was Rs 100, the original proposal intended to make it Rs 1 lakh, which is far-fetched. We have said that the fine should be Rs 10,000, which is also enormous in comparison with the current fine, so there is no need for anyone to question our intention,” Bagul said.

The body also resolved that if provision of completion certificates or fulfilling other official paper work is delayed because of the administration, no fine should be imposed on owners.
