Fresh hearing sans the past for Campa Cola case- HC

Conveyance deemed fit for the housing society much talked about in the infamous CAMPA COLA compound was set aside by the High Court, and the deputy registrar was called to speak on a fresh hearing, says a source.

This Tuesday, says a source, Justice R M Savant heard the please of Bombay Municipal Corporation which challenged a decision given by the HC in 2013 that allowed “unilateral deemed conveyance for the title, the right and the Campa Cola Land, all in favour of “Shubh, Esha Ekta, BY, Midtown, Patel and Orchid buildings”, however as the present owner of the land, BMC officials say the hearing never happened.

Prasad Dhakephalkar, advocate of the society says that the clients he serves have given no objections so far on the order impugned, and wouldn’t have an objection if they had to join BMC as a party too. A de novo is what they demanded though with the application for the same kept in consideration on the infamous CAMPA COLA housing case.

The December 2013 order was set aside by the judge and the deemed conveyance certificate was given, with a competent authority directing the same to the deputy registrar, says a source. This would help hear the plea and make a decision on the same, one that would be helpful for the society and the application needs to be in by September 4th 2014, says a source.
