Further relief for property buyers in Delhi
The buyers of property are further relieved in Delhi. In relation with the granting of the “deed of apartment” to landowners, the Delhi High Court has observed that the land owning agencies such as the Delhi Development Authority can execute the deed of apartments if builders fail to do so.
It will help property buyers to enjoy exclusive rights over their houses and they no longer need to depend on the promoter to transfer or mortgage the property. The high court observation comes in light of a PIL seeking a direction to comply with the court’s May 2010 order.
The court describes the competent authority as an official working as “a secretary in the Delhi administration or the vice chairman of the DDA, or the land and development officer of the central government”, who may be authorized by the administrator or by a notification in the official gazette under the Delhi Apartment Ownership Act.
The court holds that the first obligation for executing the deed lies with the builder or promoter of a group housing society.
