HC summons Gurgaon Administrative Officials for Encroachment around IAF base

The Punjab and Haryana High Court rejected the report that was submitted by the Gurgaon administration on construction activities in prohibited zones around the Gurgaon Air Force Station. The Court has also directed the deputy commissioner, municipal commissioner and the commissioner of police to appear in person before the court.

Reasons Cited:

The High Court Division Bench comprises of Justice Surya Kant who has passed the orders regarding the illegal construction activities that encroach the Gurgaon IAF base. He dismissed the status reports that were provided before the bench by the district administration in Gurgaon citing reasons of curbing encroachment in the restricted zone.

The Counsel for Air Force, Onkar Singh Batalvi informed the bench of fresh constructions and failure of the administration to put a stop to these based on which the court dismissed the status report provided to them and at the same time directed all Gurgaon administrative officials to appear on court in person on 9th of February for the next hearing when they will file their replies.

AIF Satisfied:

There has been one or few but several directions passed by the High Court in the recent past to stop construction of all illegal construction activities in the restricted zones.

The Air Force authorities expressed their appreciation and satisfaction before the High Court for the steps that were taken by the administrative forces of Faridabad to stop encroachment around the 100 metre area of the AIF station. As many as 1400 residential and commercial units were demolished for the unauthorised constructions around the Delhi border in Palla Area.

A public interest Litigation caused the matter concerned to reach the High Court which was a result of the plea filed by one Suresh Goyal or Faridabad. He claimed to seek the removal of constructions from the 100 metre area around the Air Force Station, Dabua in Faridabad which is supposedly a protected zone that comes under provisions of the Work of Defence Act.

A similar cognizance had been taken into consideration by the High Court for construction activities within the restricted zone of 900 metres in the ammunition depot of Indian Air Force Base in Gurgaon.
