Illegal construction removal lays in ASI’s hands, HC told
The Delhi High Court has allowed the Archaeological Survey of India (ASI) and North Delhi Municipal Corporation (NDMC) to ‘implement’ their decision to remove the illegal construction at the site in Subhash Park.
ASI has asked the civic agency to immediately remove unauthorized construction from public land in a letter, failing which the heritage body will remove it.
The bench comprising Chief Justice A K Sikri and Justices S K Kaul and Rajiv Shakdher said that ASI has full authority to carryout further digging at the site if required.
HC said though some pre-existing religious structure is unearthed at the site by ASI, the land will remain as public land and ASI will be the only authority to decide to what use it puts the site to.
The court has ordered the corporation and the police to assist ASI and ensure that the area is cordoned off.
