MBMC Selective In Targeting Builders Who Flout Rules
The Mira Bhayander Municipal Corporation (MBMC) are selective in targeting builders who flout occupation certificate (OC) norms. Small-time builders alleged that they were being harassed and threatened with police complaints by the municipality. While FIRs are being filed against small-time builders, no cases have been so far registered against the big developers who have massive ongoing projects in the region.
The civic body’s crackdown on builders began last week after the intervention of the Konkan commission, following complaints by Mira Road based social activist Saji Pappachan. The MBMC has prepared a list of 86 buildings in Mira Road Mumbai and Bhayander Mumbai where the developers and architects had not obtained the OCs before handing over possession of the flats. Names of big builders in Mumbai like Ravi Group, Rashmi Builders , Shanti Star Builders, Ostwal Builders, and Gujarat Developers figure on the list. But while FIRs are being filed, no cases have been so far registered against the big developers.
“I have demanded that the municipality stop all existing projects of the big builders who have not obtained OCs. But so far no action has been taken,” Pappachan said. A total of 17 cases have been registered with the Navghar police under the Maharashtra Regional and Town Planning Act and most of them are against small builders. No case has so far been made against Gujarat Developers, which has massive construction work in Bhayander.
Occupation certificate (OC) issued by the local municipality, is compulsory for every building before occupation. It is a stamp of completion of the property as per the approved plan, so as to be fit for occupation as per law.
Civic sources said that the builders have been given about 15 days to get their occupation certificates. Builders are expected to give in writing that they will obtain the OCs before action is taken against them. For now, the MBMC has spared architects after their profession’s delegations met civic officials.
