Mumbai high court sends notices to builders
The Mumbai high court sought response to social activist Vikrant Karnik’s letter alleging illegalities in sale of flats. The bench comprising of bench of Justices S J Vazifdar and B P Colabawala issued notices to the state chief secretary, leading developers, Income-Tax and municipal commissioners of Thane and Mumbai.
In early 2013, the court had, suo moto, converted Karnik’s letter into a Public Interest Litigation (PIL). The case will be heard on March 7.
Karnik pointed out that as per the sting operation carried out by a regional channel, builders were selling flats based on their super built-up area and sale agreements were also not proper, as developers showed the flat area to be far less than its actual area, presumably to reduce taxes. He added, the developers are now asking 60 % of the flat price in cash while the balance 40%in cheque. The loss of revenue to the government should be inquired into.
Lodha, Deewan, HDIL, Hiranandani, Conwood, Runwal and Kalpataru are some of the developers who have received notices.
