NOIDA: Builders and home buyers affected by NGT’s order
The Noida Development Authority will not be issuing completion certificates for nearly 30,000 apartments built near the Okhla Bird Sanctuary. On Tuesday Supreme Court (SC) declined to interfere with a National Green Tribunal (NGT) order restraining the Noida Development Authority to issue completion certificates. This has shattered the hopes of thousands of home buyers in NOIDA who are waiting to take the possession of their dream homes.
Another 70,000 under-construction flats near the sanctuary have also heard the alarm bell ringing after hearing about the stay by the green bench.
On April 3 this year the NGT had directed the Noida authority to stop all construction within a 10-km radius of the sanctuary. On October 28, 2013, the green bench, had stopped construction of flats near the sanctuary and had asked the Centre to fix a no-development boundary. In response to the centre’s plea on February 25 this year the UP government proposed that the no-development zone should be fixed at 100 metres. However on April 3 this year, NGT criticised the UP government’s recommendation and set the 10-km radius zone.
The builders are upset as they had obtained the necessary environment clearances before starting the projects as per the previous dictate of the 100 metre radius. Jaypee Infratech, which has about 4,000 flats awaiting clearance, challenged the NGT order. However it was declined by the vacation bench of Justice JS Khehar and Justice C N Agappan.
