Review petition filed by Maharashtra government against Supreme Court’s forestland order
A review petition has been filed by the Maharashtra government against a Supreme Court order which allows over 3 lakh people to live on the property which they have purchased on land that is deemed private forest. The review petition was filed in April.
The filing of the review petition by the Maharashtra government can likely spell trouble for the residents who have property in the forestland. The decision of the state government to file a review petition against the Supreme Court’s forestland order has come as a disappointment for the residents who have been asserting that there was nothing unlawful about their properties being located in the green belt.
In the review petition, Maharashtra’s Revenue and Forest department has sought the Supreme Court’s review of its order to remove the “private forest” tag to certain stretches of land across the state. These swatches of land include Bhandup, Borivli, Kanidvli, Mulund, Thane, Virar, Ambernath, and Badlapur.
With regard to the review petition, a senior official of the Forest Department in Thane said that the forest cover in the state is much less than the national average; and added that the green cover will witness a further depletion if regularization of constructions on forest land is allowed.
The Forest Department official said: “The department also feels that owing to ambiguity in forest rules, the law has not been interpreted properly. So the state has filed a review petition.”
