Small plots prompt DDA to seek Land Act exemption

The Delhi Development Authority (DDA) has written to the Ministry of Urban Development, requesting to be allowed to bypass governance under ‘The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013’, with regard to acquiring small land pockets.

Plans are also in the offing to put forth a proposal during a July 8th meeting to amend the Delhi Development Act, thus enabling negotiable acquisition of land by the agency. DDA Vice-Chairman Balvinder Kumar emphasised the time-consuming nature of the Act, especially regarding acquisition of small pockets of land. Formalities like social-impact assessment studies prior to acquisition needed to be conducted, he said.

The DDA maintains that although the Act (which came into effect in January this year)is acceptable for large-scale acquisitions, they should be allowed to negotiate small-scale acquisitions in New Delhi.

He mentioned the DDA’s decision to put forward a proposal seeking amendment to the DD Act, which would be important once the land-pooling policy was in place, and small pockets of land not part of the pooled land could be acquired.

As part of this pooling policy, private parties would be able to plan and develop land pockets with residential and commercial components, earlier the monopoly of the DDA. The profits from such development would be enjoyed by land owners of the pooled land.
