Supertech to move SC, says all rules complied with
Supertech CMD RK Arora, Responding to an Allahabad High Court order to raze two of its under-construction towers in Noida, declared that the projects fully complied with the rules.
He added that to protect the interest of homebuyers the company will move to the Supreme Court in a week. Demolition of the twin 40-storied towers at Supertech’s Emerald Court project has been ordered by the HC on an appeal filed by the active residents who claimed irregularities and trouble of air and light.
Arora told sources that before moving to SC the firm will take legal opinion .All the steps will be taken to protect the interest of customers .He added that the two controversial towers namely Apex and Ceyane has received all the necessary approvals as well as sanctions from the Noida Authority.
As per a lease deed dated May 16, 2005, the land was allotted by the Noida Authority, and a supplementary deed dated June 21, 2006, he further added. On November 26 the building map was approved and on March 2, 2012, a revised map was approved.
Arora cleared that between the two towers the distance is as per the demand of Noida Building Regulations and Directions, 2010, He refused the charge that due to building of new towers the old block has become unsafe and blocked light and air.
In the meantime, hundreds of exaggerated buyers staged protests over the weekend.
The Noida Estate Flat Owners & Members Association (NEFOMA) is guiding the buyers to come jointly and plan the future course of action.
NEFOMA president Annu Khan said,In the next 4-5 days we will be able to plan a strategy , whether to file a review petition in the Allahabad High Court, to lodge a police complaint, or approach the apex court.
A division bench of Justices VK Shukla and Suneet Kumar ordered the demolition “within a period of four months” of the two towers erected at Sector 93-A, Noida.In the complex there are residential premises and shopping establishments.
