TDI Infra asked to pay Rs 3.5L for deficient cancellation of flat registration
In a case underscoring deficient cancellation of the registration of a flat, New Delhi Consumer Disputes Redressal Forum has asked TDI Infrastructure Ltd to make a Rs. 3.5-lakh payment to Delhi resident Stuti Jain.
The forum’s ruling in the case was rooted in the fact that TDI Infrastructure had taken a Rs. 3-lakh deposit amount from Jain for booking a flat, the number of which was to be allotted within six months. However, rather than allotting the flat, the firm told Jain that she was being refunded 50 percent of the booking amount as the flat registration had been cancelled for not making further payments.
While the firm claimed that it had repeatedly asked Jain to make payments, Jain asserted that she had not received any such reminders.
Siding with Jain, the forum has now asked TDI Infrastructure to refund the Rs. 3-lakh deposit amount to Jain, and also pay a compensation of Rs 50,000.
In its ruling, the forum – presided by C K Chaturvedi – noted that TDI Infrastructure was found to be deficient in many other similar cases also; along with having indulged in unfair business practices.
As per the forum, the unfair practices which TDI Infrastructure has allegedly indulged in included “taking money and issuing further demand without allotment, for priority in allotment and forfeiting 50 per cent of deposit while returning it.”
