I have bought a property recently and I have faced lot of problem so I would like to advice you that do not go for any builder because some of the builder will take money and run away. So it is better that you should go with reputed builders and secondly ask them for a proper payment links so that you know how your instalments are going in the financial departments, and then you should check the previous history of the builders as some of the builder will take the payment from the customer and will keep on delaying the project. The most important thing is that you should check the location where you are investing. My comments to replies
The work on the project is at a complete standstill. The flat/shop purchasers have formed an association the Meadows Owners Welfare Association to interact with the builder and take necessary steps for welfare of the flat/shop purchasers. All flat / shop purchasers are requested to contact Deepak Trivedi and become members of the association. A united front will be helpful against the builder.
Hi Ramesh, You can not blame a builder every time. If he is not getting the approval then how can they start the work. May be your builder is facing the same problem. Nobody want to lose their reputation. You might have heard Suraj Parmar's death, a prominent builder in Thane who ended his life due to the repeated demands for bribes by the several government departments. They are also the victim of the and the the way the system works.

The builder cannot ask for service tax all of a sudden. While booking the flat only should inform you as how much service tax need to be paid by you. Hi Ravi, If you are selling your property through broker then1% is the norm from both seller and buyer, though you can negotiate on this, quite possible to settle around 0.75%. Commission is charged on the full amount and not just on the profit or whats gone to the builder. Check with your builder also on whats the transfer process and if any transfer charges. This is a part of the deal. You have to decide this, while negotiating the price . Hi Pradyuman, Getting your hands on a resale property is beneficial in several ways. Buying a resale and ready-to-move flat helps to save a good amount of money that would otherwise have been expended in paying rent or EMI, in case of under-construction property. Secondly, you don't have to face the ups and downs of this market. Everything that is in front of your eyes is yours once you own the property. And the immediate possession can provide tax benefit from the first EMI itself.

I believe in good deeds!! The downside of not registering a property is there is no way you will know if developer sells the flat to someone else or not.. Also, each year stamp duty, service tax, etc is going up resulting in the cost for the same going up as u delay registration. Why take chances with hard earned money by not registering the property in u/c stage??I believe in good deeds!! I somewhat agree with the above comment by Mr Gupta. I feel if you are looking for buying an apartment for self use then go for developed areas like Kharghar or Seawoods in the vicinity. Ulwe has good demand and has good potential for returns but we see a high rise in price which has taken care of the good demand! Investments with really long-term horizon, risk appetite and ready for bumpy ride should get-in, if you want to take a crack at it.I somewhat agree with the above comment by Mr Gupta. A 3.09% service tax was asked in advance on the amount of 30% I paid and on top of that no invoice or receipts were given to me.. I feel like losing my hard earned money and not getting any assurance as of now. Please very very careful with this builder. He would say luxury apartment but the amenities are not upto the standard. He also cheated people in car parking. he sold extra car parking with premium rates by squeezing all car parking. People can not even park maruti comfortably.So please take everyting written in the agreement.

Hi Ankur, Before you finalize any project, it is advisable to check few essential points. These are 1) Ground report, 2) In good company, 3) Quality Certificate, 4) Realty ratings and 5) Financial stability. For all that, you can do a quick internet search by keying the company name in customer forums, blogs, news reports, property sites, etc. It would have a lot of information). It will better if you do field research.

The idea of the new elevated link emerged during the execution work of the fifth and sixth lines between Thane and Diva. This option is being considered as the earlier option of an elevated corridor between Thane-Kalyan and CST-Kurla would not be feasible due to land and engineering related constraints. MRVC also realized that the existing corridor could not be extended from Panvel to Thane due to the Parsik tunnel. However, connecting it via Kurla would be financially viable.
The civic body is planning to submit the proposal for the additional line to the railway board in a fortnight. The approval process may take about three months and preparation of a detailed project report would take an year after approval. A railway board member said that the proposal was feasible since the CST-Panvel corridor passes via Kurla and only 15 km of additional line has to be built between Kurla and Thane. This new line will also bypass the existing CST-Byculla-Dadar-Kurla main line.

Areas in Thane, Navi Mumbai and Mumbai Metropolitan Region (MMR) too have seen a fall to a certain extent in apartment sizes in the investable-grade category according to Jones Lang LaSalle (JLL). Mumbai is witnessing a considerable fall in apartment sizes since 2008. According to JLL, apartment sizes in Greater Mumbai in 2008 were on an average 20% larger than those on a pan-India level. While the median size of apartments remain almost constant at approximately 1,600 sq.ft at a pan-India level, the unit sizes in Greater Mumbai have greatly reduced and are currently almost 15% lesser than other cities. This is a fall of approximately 31% from 2008.

According to the new system, the proposed property tax is 0.35% of capital value for residential units, 1.3% of property value for offices and 2.6% for banks. This will increase property taxes by 100%-300%. For example, the property tax for a 1,000 sq.ft. in localities such as Cuffe Parade, Nariman Point, Napean Sea Road and Worli will be between Rs. 8,540 and Rs 24,690. The taxes in areas such as Ghatkopar, Mulund, Kandivali and Borivali will be between Rs.3,280 and Rs 3,850.
Old buildings will be paying less while redeveloped and new buildings within the same area will be paying higher taxes. For example, old buildings on Napean Sea Road will be paying Rs. 1 per sq.ft. per month while the adjoining new/redeveloped building will be paying Rs. 24.69 per sq.ft. per month which is almost 25 times more.

The proposed tax system will lead to a huge disparity between the suburbs and South Mumbai, considering residents in both regions get the same service from the municipal corporation. Also, the high property taxes for redeveloped buildings will hurt the city's redevelopment market, forcing people to move outside the city.
The new tax system will impact more than 2 lakh self-occupied, vacant and leased properties in Mumbai. Several organizations including the Property Owners' Association had filed a petition against the new property tax regime in October 2013.

Once this hike happens, the stamp duty over property transactions will be hiked to Six per cent in Mumbai and seven per cent in other areas of the MMR. Pune will also see a hiked price of 7 per cent.
The proposal is awaiting cabinet approval. And I also here that this proposal is part of the revised plan for the Mumbai metro route-3 project which will connect Colaba to Bandra, Seepz and the Airport.

The municipal corporation's move comes in the wake of increasing right to information (RTI) related applications regarding illegal constructions in the city. Illegal constructions are rampant in Mumbai and its suburbs. Most of these illegal buildings either collapse or are demolished by BMC. Individual flat owners are the ones who usually bear the brunt of these illegal buildings. The recent Campa Cola incident was an apt example.
As far as I know there were also suggestions for the BMC to put up a list of buildings whose building plans were sanctioned, which would help potential buyers to identify legal buildings.

Mr Ramesh, Glad to know that you are planning to buy a 2 BHK flat in Rustomjee Urbania. Heard that they are charging Rs. 93 lakhs for flat having an area of 590 sqft. If you are looking at bigger area, then you may have to shell out 1.30 crore for flat measuring 1210 sqft. It is upto you to decide since you have to make up the mind and arrive at a decision. Rustomjee Urbania is located in heart of Thane city close to Eastern Express Highway and just 10 minutes from Thane station. It is also near to Mumbai-Pune Expressway and has all the facilities like schools, colleges, markets, banks within a radius of 3 kms.
Yes Mr Ramesh the project has all the latest amenities and having a mini township you should go for it at the earliest. No Mr Sunil, As off now there is no metro connectivity to the project. The project is itself within a township and enjoys all basic amenities like super markets, banks, pharmacy stores etc. It is at close proximity to Hiranandani Business Park, reputed schools, colleges, Cinemax, Wonder Mall, close to retail food outlets like dominos, Pizza hut etc and is just 30 min drive from Thane station.
Wow!!! sounds Awesome to be near to all retail outlets which are within striking distance from the project. One need not travel to far away places since everything is available within the townships.

Dear Sunil, They are quoting Rs. 87 lakhs onwards for 2 BHK. The rate they are charging is Rs. 8400 per sqft. Yes offcourse the project has got all sanctions and approvals from TMC. The connectivity and infrastructure is good as it can be reached by both rail as well road modes of transport. Eastern Expressway Highway is just 10 minutes and Thane station is about 7 kms from the project. Regular bus services are available run by TMC to Borivali, Airoli, Vashi, Thane station and towards central and south Mumbai. The project is also near to proposed new 6 lane expressway connecting Ghodbunder Road with Borivali. There is also a proposal to connect Thane with a metro rail network.
Hi Kishore, The project is also close to major retail malls like DMart, Croma, Reliance and RMall. There are temples like one dedicated to Sai Baba near SD Bhalerao. The monorail will be linked with major local train stations. Since Chembur is the nearest station it will be connected with a skywalk with mono rail station.
Wow Beauty!!!! Heard that it will have a frequency every 15 minutes and will run from 7 in morning to 3 in evening which will be later extended upto 12 in midnight. Do you know that all the coaches are air-conditioned and has a capacity to carry about 560 passengers. It has a top speed of 80 kms per hour.

But you have not mentioned about the budget you are looking at??? You will find many second homes in places like Igatapuri, Lonavala, Khandala, Mahabaleshwar with a price tag ranging from 1 crore to 5 crores. Having an asset in form of second home will further mean long time financial security. In addition, appreciation in capital values can result in a significant corpus via sale of the asset, if and when needed.

The cost for 1 BHK starts at 60 lakhs onwards including registration and stamp duty charges. They are qouting Rs. 7500 per sqft and this project was launched 2 years back.

Hi Kunal, I paid a visit to their site office and got to know that work has already been commenced and possession will take place by Dec 2016. Also saw the sample flat which really impressed me. The living rooms were quite airy and well ventilated . The kitchen was modular type and the bedrooms were quite large.

Hi Sankalp, Yes only 1 and 2 BHK flats are only available in this project. They dont have any 3 BHK flats here. The price for 2 BHK range from Rs. 65 lakh onwards and it has an area of 940 sqft.

Hi Ravi, Came to know that price starts from 25 lakh onwards for 1 BHK having an area of approx 700 sqft onwards. 2 BHK come with an area of 850 sqft and are priced at Rs. 31 lakhs onwards. The area for 3 BHK comes around 1100 sqft and price starts from Rs. 40 lakh onwards.

Hi Sandeep, Many leading banks like HDFC, SBI, India Bulls and ICICI banks are offering finance for this project. It is upto you to decide whether you are opting for fixed method or floating method. In case you are going for long tenure repayment, then I suggest fixed method is the ideal one to opt for.
Yeah you are right Mr Shrkant. In fixed method your interest rate remains fixed throughout the period you are taking loan, where as if you go for floating method, interest rates keep varying in and down. If the rates are down then ok, but the rates go up then you need to pay higher interest.

Mr Anuj, 2 BHK are priced at Rs. 1.09 crore for flats having an area of 900 sqft. The amenities offered are club house, swimming pool, broadband connection, jogging track, 24 hour power backup, community hall and garden. Hi Sandeep, You see as off now no new developments have tend to take place in Mulund west. But yes there is a proposal to link Mulund with Ghatkopar with a metro rail. The plan is still under proposal and may take some years to finish. Once the metro rail begins its operations, then I think the property prices will touch sky high. Hi Sanjana, Yeah even I too came across the fact that property rates in the eastern districts like Karjat, Neral, Shelu and Khopoli are going to bounce by 2017. This is mainly due to property investment here remains a good, safe, low-risk investment with average rates of Rs 3000 per square foot and an upward trend incomparable to other areas in the real estate market.

Hey Ravi, Got to know that the project was launched in the year Nov 2013 and construction work is going on in full swing. The project will be ready to occupy by June next year. The builder is quoting Rs. 25500 as rate per sqft. The apartments are well linked by road and rail mode of transport. Borivili station is just 3.5 kms from here and Western Express Highway is also at close range from the site. Buses, autos and taxis are also easily available from here to reach various other localities of Mumbai.
Hi, I also heard that there are many good no of super specialty hospitals located around 4 kms from the site. One can enjoy shopping as many retail outlets like Croma, DMart, Pantaloons, Thakkar Shopping Mall, Moksh Plaza and Annex Mall are within close distance.

Dear Sandeep, Heard that this is one of the hot projects coming up in this part of the city. Came to know that upon inquiry the project was launched in the year Oct 2013 and schedule completion will take place around July 2017. Totally there are 15 floors in this project. If you buying the flat from investment perspective then absolutely you can expect a high rate of return. Since many upcoming infrastructural projects being coming up in Chembur like opening of mono rail, prices are soaring and hence there is a huge demand for houses. Hence you can expect a high level of appreciation in another 5-6 years down the line.

Hi Everybody, If you are planning to buy property in navi Mumbai then Panvel and New Panvel should be your top priority. New Panvel is an upcoming residential and commercial node currently being developed by CIDCO in the Panvel region. The node is divided into 2 parts: New Panvel (E) and New Panvel (W). The area is situated strategically on the eastern side of the Mumbai-Bangalore National Highway and Mumbai-Pune Expressway. It also lies adjacent to the upcoming international airport.
Right Vasanth, On the other hand Panvel in Navi Mumbai, is one such locality. Not only does it offer housing in the affordable budget, yet it is also very well connected to key areas in MMR such as Sion, Mankhurd, Vashi and CBD Belapur. Well, they are known to have options in 1BHK,2BHK and 3BHK of sizes 705 sqft,950 sqft and 1280 sqft respectively. the current price is Rs 3195/sqt and there is availability of apartments in this project.

Well this 3 acres project has roughly 400 units in 14 towers of 7 stories each...so there will be 4 flats on each floor. i was advised that all the approvals and paper works are in place and that there will be no issues for getting loans also.

Q: Hi, i had shown interest in Airoli Green World project for this i had been to their office and spoke to Akshar's marketing executive. As per his words had paid some amt to book the flat and he gave me written on a chit. 2 weeks back i paid to him a Cheque to get the allotment letter.. However they havent yet processed the cheque and giving some or the other reasons. Need a help as to why they are taking so long to process it. Is my money safe? Hello. To all those that have been talking against this happening. There is some bad news. The Kshipra river has been revived with the help of the Narmada river sources and hurting the sentiments of a godmen were not the concerns as there was a lot more at stake here.

The property is under construction and will be ready only by 2016-17.. so its a long term investment as of now.. Hi, i guess the BSP is around Rs 7000-7500 per sqft but these rates are always negotiable at least a little bit so you can speak to the dealers at the time of booking and try to get the lowest rate.

Yeh..... The property price for Sakinaka is currently between Rs 9500-11500/sq-ft. By 2015 it is likely to go up to Rs 14000/sq-ft. Investment in Sakinaka was much cheaper than its neighbouring Powai. Hiranandani Complex there is witnessing rates up to Rs 30000/sq-ft. Areas like Dahisar too are witnessing prices above Rs 10000/sq-ft so Sakinaka may comes as an obvious bet.

HI, Yes, you can sell your property which is under mortgage to bank. If buyer also needs a housing loan from bank to buy the property. This process is called SELLER BT. In this case the same bank or the other bank will transfer the amount to the seller. Well Ravi, The MMRDA plans to bring 175 hectares in Bandra-Kurla Complex under wi-fi connectivity. The internet speed will be 5 MBPS and operators may allow visitors free usage for the initial few minutes and then charge as per the prevailing market rates.

Yes, you are right ravi, It can be executed by March 2015. The estimated cost will be ascertained only after the proposals. A smart parking concept will be implemented across all the 3000 parking slots in BKC as part of the project,. A person entering BKC can pre-book a slot online or arrive at the place, check out the spaces available on his mobile phone or display boards and make straight for them.

@Ravi, Other environment-friendly initiative in the pipeline is the solar smart street lighting system. This system will be almanac-based, so that the brightness of the street light can increase or decrease according to the natural light and do away with wastage of power. This will help us earn carbon credit because of the use of green energy. Around 90 CCTV cameras with video analytics-based technology will be installed to boost security in the financial hub.

The builder has quoted me a BSP of 10990/sq-ft and the total cost of a 2BHK will be in 742 sq-ft. carpet area works out to Rs 1.6 crores. After reading all views here, I think, this is quite an expensive proposition. Well Sandeep, 1BHK from 603-729 sq-ft., 2BHK in 828 sq-ft. and 3BHK in 1170 sq-ft. The current price quoted by the developer is Rs. 10500/sq-ft. The cost of 1BHK will be Rs. 63.31 lacs to Rs. 76.54 lacs, Rs. 86.94 lacs for 2BHK and Rs. 1.22 Cr. for 3BHK. This price is all exclusive. Almost all the financial institutions such as ICICI and HDFC are offering loan for that.

Hi all, I wanted to know the construction at Nirmal Olympia going on. Is the construction good. whether the land is freehold or leasehold and whether the title is clear. whether the land is not a notified area like a forest land by the govt. will the builder give all the amenities as promised. I am a bit worried about all these aspects as it is my first investment in Mulund East. Also, whether we can pay the cost in instalments as and when the slabs are ready.
Hi Kishore, Better you visit the developer's office and ask for the legal documents. You can also verify it from the nearby municipal corporation regarding the lease hold and free hold land, clear title and notified area. As i know that several banks are issuing housing loan then there should not be any doubt of installments as and when the slabs are ready.

Well Kishore, As far as my knowledge is concerned Mulund West is a suburb in the northeast of CST. It has a railway station on the Central Railway Line of the Mumbai Suburban Railway. It has easy access to the Eastern Express Highway and Navi Mumbai through the Mulund Airoli Bridge. It has rough concrete roads, mostly around 12 to 15 ft. wide. The area has good underground drainage and sewage system, though it is prone to flooding during monsoons. The area has parking issues. The traffic in this area is heavy but well modulated. The expected date of possession will be around December'2018.

Hi Guys, As per my knowledge, to everyone's surprise, the latest ready reckoner rate hike , 14% on an average, by the state government is the lowest of recent years. the hike for Mumbai (municipal corporation area) is an average of 14.81%. Resultant stamp duty revenue : Rs 280 crore, the highest over two days in recent years.

Q: My parents have purchased a land in Bangalore during 1992 under GPA registration. We did not registered the same. The land purchase as follow A party has been registered to B party. B party has given GPA to C party. C party has sold the land from GPA to us. Now I am planning to sell the land but the customer are telling that the documents has not been registered. During that time they have paid Betterment charges, Khata and paid up to date taxes etc., Now it has come under BBMP Limits. I have already taken A Khata, Khata Extract & EC from BBMP. Everyone are telling to find B party who has given GPA to C party (C party is not alive). We could not find B party. The stamp vendors agents are telling if you want to sell the land, first you transfer the document from your mother under gift deed and get is registered and later you can sell the land without any problem. Please let me know if i can proceed and doesnot get any problem in future. Once the gift deed procedure is over all the docuements like Khata, EC, Taxes every thing will be under any one of the family member name. Is it true, please explain and help me how to proceed further Now one of the person is intersted to take the land and he is telling to provide the family tree certificate. Hi Arup, I think you have a vast knowledge of this locality. But very frankly, i would like to tell you that this area is yet to be developed in terms of social infrastructure, civic amenities and housing. There are proposed plans to improve the rail connectivity to the area. The planned monorail line between Mahape and Kalyan will pass through the area. Once, it will complete, the property price in the locality will increase at a fast rate. So, if anybody buying or investing property here can get a good return in 3-5 years.

Hi Aquib, Before taking any legal action, check you agreement whether there is any clause mentioned for compensation on delay possession and secondly, interest on service tax. If it is mentioned then consult a good legal expert and follow what he says.
Hi Aquib, Service tax is applicable on under-construction flats Since the flats are under construction, there is an element of 'construction service' in the agreement between builder/developer and purchaser. Hence, it attracts service tax. . While service tax is charged at 12.36%, in case of under construction flats, the effective rate works out to 3.09% of the value of property. This is because service tax is not applicable on the entire purchase price.

Thanks Jerome, If we have knowledge, nothing bad to share with the other needy people. May be it helps a lot to them buying their properties. Locality play a major role in terms of buying property. When it comes to Nalasopara, Nalasopara West is more developed and offers good 2BHK apartments with budget up to 45 lakh.. But be careful about Nalasopara East as there are more illegal apartments.

Though it is near to your work place but very few apartments are available for rent. The next area is Santacruz West and Andheri East but little bit far from the Parel. Here some apartments and flats are available in 2BHK within your budget.
Right Shrikant, Santacruz West is 10.9 kms from Parel and it will take 38 minutes via Swami Vivekanand Road during office hours and 28 minutes without traffic. Similarly, Andheri East is 18.3 kms from Parel and will take 40 mins via Dr Baba Saheb Ambedkar Road and NH-8. There are many 2BHK available in your budget.

True, Andheri West is not a bad idea Shrikant, It has a good physical, civic and social infrastructure. It has good connectivity and proximity to business areas like SEEPZ & BKC. Here, you can get a 2BHK between Rs. 30000-60000/month. But the average rentals have remained above Rs 45/sq-ft. during 2014, and have continuously witnessed an increase. Due to the metro rail in the area, there has been an increasing demand for rentals here.

It is one of the most vital Commercial Hub that houses special economy zones such as SEEPZ and MIDC. So, investment point of view it is a good locality. Current residential property rate in the locality is between Rs. 18500-24000/sq-ft.
I think Ramesk is right. Andheri West has a good physical, civic and social infrastructure. It has good connectivity and proximity to business areas like SEEPZ & BKC. As a result, apart from sales, it has good demand for rentals. The current Mumbai metro is an example of it. But i am not sure about the delivery date of this project. Nobody can tell you what is going to happen in future with this project.

Q: I stay in Mhada colony in Mumbai. There are 50 buildings in this colony which was built in early 50s. All 50 societies decided to go for clustuer development under DCR 33(5) and formed a federation. The redevelopment procedures are followed as per 79(A) guidelines. Now we are at the stage, where 5 builder/developer are finalized and each member has to select the developer in the AGM. All 5 builders are offering different carpet area and different the corpus. Few developers are offering the carpet area as per the entitlement rules under 33(5) and claims that developer can not offer additional area from the sale component. If this is done then it violates the law. Can developer offer more than the entitled area to us, if there is no impact to the Mhada entitled area and developer is willing to take hit on his on sale component?

Hi Raja, Yes, a developer is entitled to offer you more are in following circumstances:- A basic entitlement of 35% above the existing Carpet Area or 300 sq-ft. whichever is higher guaranteed as per Redevelopment of MHADA Colonies in Mumbai under 33(5). Incentive higher carpet area for cluster redevelopment. Incentive higher carpet area for redevelopment by MHADA. Incentive to developer for redevelopment based on the ratio LR/RC Sharing of balance FSI between MHADA and Society. If they are not ready to give you the additional area from the sale component and violating the law, you are free to take the service of other developers. Raise the issue in the AGM and avoid developers.
Here are the incentive Carpet Area for Cluster Development :- If the area of the plot upto 4000 sq-m under redevelopment incentive will be nil, 4000 sq-m to 2 Hect, incentive will be 15%, 2 Hect to 5 Hect, incentive will be 25%, 5 Hect to 10 Hect, incentive will be 35% and above 10 Hect, incentive will be 45%.

It's current price per sq-ft is Rs.12000 and a 2BHK will cost to you Rs.11880000 and Rs.12600000 onward respectively. There are 12 building coming under this project but 11 building has been successfully sold out. This project is ready to move and around 425 families are happily living.

Hi Suresh, The construction work is in progress. They were initially going to give possession of one phase in October, but due to delay in getting NOC from Fire Dept., it will be given in December,2015 alongwith all other buildings now.
I think Rakshit is Right. I have booked my flat in "Solitare''. I had visited the project last month. It was almost completed. Plumbing and electric work were pending, was expecting soft possession by December'2015.

Hi all, It is really a matter of sad that developer of this project is no more with us. As per my discussion with them, they said they will be giving possession in March 2016 now instead of December mentioned earlier. Hope, we will understand the matter. If we can wait for 2 yrs. why not 2 more months. At least our developer is not fake.

Right Aneek, They have mentioned in his last letter before die that as much as Rs. 800/sq-ft paid to the approval dept. and politician as a bribe to get approval. Three months before builder's death, minister of state for home Ranjit Patil directed TMC Official to clear Parmar's project, but no action was taken by the TMC authority. He begged state minister for help before killing himself. But the TMC authority has evoked the stop worked order imposed on the project Cosmos Jewels, Ghodbunder Road, Thane.

Kishore is correct. HDFC is leader in Home Loan services, SBI too is improving it. But at the end, I will only say that do all necessary homework and choose a home loan whose deal best suited to you. Private banks are very fast and friendly at the time of disbursing the home loan, they will treat you like a king up-till the loan is disbursed, but once every formality is complete and your home loan is sanctioned, you are a trash to them! As they are extremely agressive in marketing of home loans, a lot of people fall for it, Private companies presentation and they way they approach you is good but only till you are not a home loan customer. A lot of times private companies make things easy for you and also bend some rules for home loans. the number of documents they need also is less compared to a PSU bank.Kishore is correct. No, this is not true. Price depends on the floor, preferential location and the amenities. High rise charges are included in BSP. Similary, if you are booking your flat as per preferred location, it will cost you extra, at the same time you have to pay for the extra amenities like badminton court, cricket stadium, gym, yoga club. These all charges included in your BSP which increases your price and if you are not availing those facilities then your price may reduce.

Even the locality price is 9340/sq-ft. whereas builder is charging Rs. 9500/sq-ft. Q: I have purchased a flat in Mumbai in Oct 2010 . Got the same registered in Nove 2014. Agreement value is Rs.56,55,220/- Paid Rs 56552 as MVAt to the builder i.e. 1 % of the agreement value. But the builder now claims I still have to pay Rs 5613/- balance of MVAT as the market value of my flat in november 2014according to ready recknor is Rs.62,16,500/-. According to the builder MVAT Rate 1% is applicable on either agreement value of market value, whichever is higher . Is what the builder demanding legit?

Hi Sunil!! No, they can't. Only a farmer can buy land in Maharashtra. If you are a farmer you can buy. But for bonafide industrial use, you can buy up to 25 acres with the permission of collector.
Yes, i am agree with Kishore...... ONLY an Agriculturist of any state of India can purchase agricultural land/s in state of Maharashtra. (Non-Agriculturist is prohibited from purchase of agricultural land by law). The purchaser agriculturist has to produce proof of he being an agriculturist by submitting 7/12 extract in his favour, to the land revenue officer – Talathi of the respective village, without which ownership of such purchased agricultural land/s cannot be transferred.

Hi Gautam, Do’s and don't's while buying a agriculture land:- 1) Do not purchase agricultural land if you are not an agriculturist, 2) Confirm whether the land sale is prohibited by the State Govt. for any reasons mentioned above; and purchase only after prior permissions are obtained from concern revenue authority of the State Govt., 3) Do not construct farmhouse without permission.Use the land for the purposes mentioned herein above, 4) Visit & inspect the land before purchase, 5) Collect / Obtain KHATE BOOK-LET from Talathi & get it updated every year, 6) Verify the title of land through legal expert, 7) Obtain fresh 7/12 extract every six-months/year & check encumbrances if any, 8) Confirm & verify that the ownership of land so purchased is transferred in 7/12 extract & mutation entries are recorded in 6/12 extract in your favour.

Q: Have seen in some posts that alta Monte is build on part of cemetery land. Wanted to know was this cemetery active before the land was occupied. And what will be build on this cemetery land now. Is BMC allows to have cemetery land near residential housing? Will this cemetery be given to public to be in use after project is completed?

Hi Madhuika, According to Appendix 4 of the Development Control Rules 33 (10), a developer who utilises cemetery land for redevelopment is supposed to return 25% of the original plot area after the project. This means for the above plot, Omkar Realtors had to give back 1496.90 sq- mtr to the SRA.
In a slum redevelopment project in Malad (East), the Slum Rehabilitation Authority (SRA) did some innovative calculations and let the builder (Omkar Realtors) to keep a big chunk of land, which was originally a cemetery. However, the SRA’s calculations told Omkar they only had to give 498.99 sq-mtr this means the builder would give back only 8% of the original cemetery plot, instead of the mandated 25%, keeping a mammoth 92% for himself.

As per Omkar Realtors and Developers, there were no irregularities in the project. It said it had no role to play in the eligibility issue as the matter is between slum dwellers and the authorities. But a FIR had men tioned only Rs 150 crore but was later changed to Rs 415 crore. “Out of said 1000 sq yards, the SRA has declared area of 750 sq yards as slum under Maharashtra Slum Act. The matter is presently pending with City Civil Court and High Power Committee (HPC) appointed by High Court. No incre mental FSI is granted by SRA to the devel oper
But EOW is saying that they are looking into all the aspects of the case. Firstly, they will go through the documents and they decide on further course of action. I don't know about the project whether the construction work is going on or on hold.

Q: Date of posession promised while booking the flat was sept 2014 while in the contract they mentioned dec 2015 as a late date. Even after that we are waiting for the posession. Builder is not replying to mails and gives rude response over phone calls. They are saying it is delayed due to delay in power grid making by the govt authorities and they are not responsible for it. ON WHAT BASIS THEY PROMISED POSESSION OF SEPT 2014. We are staying in a rented flat and paying EMIs for this long awated flat.
