Q: Hi All, Hope u guys are aware of the latest news about the Worli ( Campa Cola Society) demolishen. 170 flat owners have been asked to leave just because they did not have the occupancy certificate.. Although the flat owners had paid their yearly taxes and had the flat registered 20yrs ago, the govt has declared it to be illegal.. This only reminds me that few blocks in PWC are still not given with the OC. Note: This is not to create any worry, just a concern that we all need to squarely plan and resolve.

Hi folks..... Apartment buying demand a number of important and necessary documents. Occupancy Certificate is one such document, which is in place to safeguard the interests of an apartment buyer. This document is obtained by the builder from the office of the local civic authority such as BBMP or BDA in case of Bangalore and BMMC, TMC,CIDCO are in Mumbai, Thane and Navi Mumbai respectively. The OC essentially tells you that the owner can legally occupy the building.
Very True Ramesk..... OC is an essential legal document that has to be obtained by the builder once the construction is complete. This ensures that the building has been constructed in a completely legal way adhering to the approved plan.

Q: The Lake District Project is delayed beyond comprehension. We have booked a 2BHK Flat in Bldg C4 in Jan 2011 which is a part of the Phase1. As per the agreement the Apt should have been handed over by Dec 2012 considering all the grace periods of more than 6 months. The building has only reached 6th floor out of the 12. How many are such agreived parties? Can we join together and issue a notice to the builder?

Hi Has the builder contacted any of the members for the handover of the flat and if so are they asking any of you guys to sign some indemnity bond indicating that you give up all your claims for the delay in the delivery of the Flat. It recently came to know me that the construction work is the progress is faster than last few months and construction of club house and swimming pool is in full swing, few owners are staying in their flats. Better, visit the site see the status with your naked eyes. Don't just go by " heard and found".

Q: Hi I had purchased a flat in taloja in sep, 2013. Builder has already got occupation certificate from CIDCO in oct,2012. Now he is demanding vat tax 1% from me. Without that he will not give possession to me.. I have already paid other dues. Pls suggest do I need to pay vat tax 1% to builder.

Hi Nikhil, Following documents are requiredfor transfer of ownership of property: 1) Proof of ownership (Sale Deed), 2) No objection certificate given by last/original owner or from Co-op Housing. Society, 3) Property tax payment receipt for the whole financial year, 4) Transfer fee - 1% of the taxable amount, 5) Abstract of property card issued by the Corporation. In case no objections are raised, it takes 21 days. In case objections are received, it takes 45 days to complete the process of transfer of ownership.

Hi, It that the Pimpri Chinchwad Municipal Corporation's Local Body Tax (LBT) collection has crossed the Rs 900 crore mark for the 1st time since it was introduced 2 years back. The collection for the financial year 2014-15 now stands at Rs 903.2 crores. It is really a good news that people are paying their taxes on time. It will really benefit them as well as the govt.
Hi Hamsika, It happened because the state government had finished octroi and introduced LBT on April 1, 2013. The PCMC had earned Rs 1,094.52 crore as octroi in 2012-13, a year before LBT was introduced.

From city's development point of view it is a good news but at the same time if we think about the slum dwellers's point of view, it's a bad news because PCMC, Pimpri-Chinchwad's dream of becoming a slum-free city received a body blow with the central government directing the civic body to finished the project by March 31. This would mean the dreams of 11000 slum-dwellers' families, who were promised a 270 sq-ft flat each for Rs 50000, will be shattered.
But we shouldn't forget that after a long time Under the Central Government's Basic Services to Urban Poor (BSUP), PCMC launched a plan to rehabilitate 18000 slum-dwellers' families in 2007 and make Pimpri Chinchwad free of slums. It was a Rs 369-crore project of which the Centre's share was to be 50%, the state government’s 30% and PCMC's 20%. The scheme was to be completed in 2010, but was caught in court litigations.

Transfer to Vanikaran land to a non agriculturist obstructed under Section-63. However collector may grant permission for transfer under the below mentioned conditions: 1) Such a person bona fide requires the land for a non agricultural purposes; or 2) The land is required for the benefit of an industrial or commercial undertaking or an educational or charitable institution; or 3) Such land being mortgaged, mortgage has obtained from collector a certificate that he have the intention to take the profession of an agriculturist and agrees to cultivate the land personally; or 4) The land is required by co-op society.

Hi, Hi, Buying a home is a big decision now-a-days. Most invest their hard-earned money into buying a house. But what if we don't get possession on time? In such cases, the flat purchaser can file a consumer complaint for deficiency in service as defined under the Consumer Protection Act (CPA), 1986, against the builder.
Here i am expressing some reason for delay possession. A delay in giving possession can be due to various reasons such as pending municipal approvals or some dispute. Or if property prices are rising, the developer may intentionally not give possession in the hope of making buyers pay more even if the agreement has been signed at older rates. This will not reflect in the sale agreement.

I think you are right Hamsika, Being a resident of the country it is our prime duty that we can discuss on any topic which helps the common people. And it is a good idea even the plot having 1000 sq-mtr. of area should register with the regulator....and most of the members are in favour of doing away with provision of treating "bulk buyer" as developers since this may put a brake on the investment flow to the real estate sector.

Hello Shweta, But with the Municipal Elections schedule to be held next year, the proposal is likely to face opposition from a large section of corporators when it comes up for discussion for discussion before the standing committee next week.
As per the head of property tax department PCMC, the department has proposed a total hike of 5% in property tax for residential properties and 7% for no-residential properties for 2016-17. The department hopes to get an additional of Rs. 42 crore if the proposal is accepted by the civic general body.

Earlier, the department had proposed similar hikes for the previous two financial years, but they were rejected. But we hope that this time, the proposal will be approved. Although PCMC is not facing any financial constraints at present, it is taking efforts to increase revenue only.
@Gauri, It is also come to know that the proposal has suggested a 1% increase in drainage benefit, water supply benefit and road taxes for residential and non-residential properties.

They also asked the 20 selected cities to get the projects off the ground by June 25, the day Smart City Mission completes one year of its launch
Yes, and those 20 cities selected for the smart city mission will start their projects by June 25. Everything will be observed and everything will be watched. Money cannot be spent for other purposes. They also called for co-operation from the people for the success of the project. A city can not be smart if people don't co-operate with the administration.

Mr. Prabhakar, Did you talk to the builder regarding construction work? As of now this project is on hold. They are saying that they have required approval but i think they are still waiting for the commencement certificate. Good afternoon Sandip, it is very difficult to say that which builder is good or which not and whether they will deliver the project on time or not. It only depends on the stautory approval and the construction norms fulfilled by the builder. If they complete the construction work on time and as per the construction norms, they will must get the Completion Certificate, that allow you the enter into your flats and if they didn't then project can get delayed by years. So, do all ur due diligence before buying property in anywhere.

Are you sure that builder will give possession of this 50% complete building on time? And registration amount went to govt's account, so your builder can't get it back. He is just giving you false promises. Don't go for another building, you might get a lower floor area and amenities are not as per your first building plan.
Yes, Ramdas is absolutely right. Builder is giving you false promises. Better, if you can take the advice of a local property lawyer. he will suggest you the right way. Suppose, if the builder is unable to transfer the said registration charges within 90 days in your account then you have to suffer the double loss.

Hi all!!! Have anyone of you completed registrations for 2/3 BHK apartments in 2015 in Life Republic? What is the survey number for Life Republic. The survey number provided by Life Republic on their site only provides registration details for row houses done in 2012 and nothing elset.
And yes, the possession as usual has been delayed by at least 2 yrs. but it seems they have just started giving possession to one of their R7 flat floor wise...don't how that is possible as they won't get a completion certificate unless they complete the entire building. The overall project seems good andas potential of becoming a good to live place but only after several yrs. ...

Q: Builder charged all owners lump sum for Repair & Maintenance Fund and also Sinking Fund. Now prior handing over Builder showing excess expenditure (almost double the collection) on maintenance and asking additional funds. alternately he is going to transfer from sinking to maintenance fund. During last two years when he was carrying out maintenance, he never intimated any member about excess expenditure nor did he give accounts of the expenditure.

Hi, Ideally, new construction requires very less maintenance but it is another way round. Builders charge maintenance at the rate of Rs 7 to Rs 10 psf which is a very princely amount. I am agree with Bhaskar. Not worth staying or investing In Dhanori, especially Porwal Road. This area is too much crowded without proper road, water and street light. But it would be the best if you visit this place (Porwal Road) around 6:30 pm, to get a real scenario of what you can expect if you move here. Q: I rented a 1BHK flat in Andheri and signed 11 month leave & license agreement 5 days ago. There is a 6 month lock-in and 1 month notice period. Due to some misunderstanding and lack of furnished items in flat and owners mean behaviour, I (the tenant) want to cancel the agreement . However the owner said he will not return the deposit of 50,000 but he will return the cheques of remaining deposit and monthly rent if we sign the cancellation agreement, thereby waiving him of 50,000. Is it legal for the owner to do so ? And if there is any way I can get my money back without legal troubles with owner in future on cancelled or stop cheques in case I don't agree to waiving my deposit left with him ?

No, its illegal. Owner has no rights to waive off the deposit. Better, you file a case against the owner in consumer forum. You can also take the advice of a legal expert in this matter.
HI Vikrant, If you have any way of proving that you have paid the deposit money you can file a suit for recovery of the money. I’ll suggest you to meet a lawyer in the city for better advice.

Hello Chandra, The rate is quite competitive at 4800/sq-ft. I agree that under construction property is a risky affair. However if you look at Paranjape Blue Ridge and Naiknavare Avon Vista located in the same vicinity have rates much higher than lots of projects that falls under PMC. So, as per me you can go for it as the price is reasonable.

Hi Sunanada, The benefits of investing in under-construction properties will outweigh the benefits of investing in ready-to-move-in homes under the new Goods and Services Tax (GST) regime. The actual GST rate on under-construction properties is 18 per cent. However, the effective tax on such properties would be 12 per cent as under the new regime developers will be allowed input tax credits.
As far as home loan EMI is concerned, here is how the GST actually affects on home loan EMIs. It will make the equated monthly instalments (EMIs) cheaper for people with home loans for the under construction properties. GST levied on home loans is 18% across the country. Service tax and VAT are no longer applicable. The rate of interest has gone up significantly. Lenders and banks will increase the rates associated with the home loans.

Hi Vishal, The Baner-Balewadi area may be a hub of development, but basic amenities such as water supply are still sadly lacking despite ample supply in the dams. In March 2017, the Bombay High Court (HC) issued a warning to the Pune Municipal Corporation (PMC) over its discriminatory approach and ordered that no new construction was to be allowed in the area, unless the civic body takes concrete steps towards tackling the acute water shortage.
Yes, even the HC also rapped the civic body for being more concerned about generating revenue than ensuring that facilities are in place. The locals had alleged that they have contributed over Rs 800 crore to PMCs annual budget. But, despite their upmarket location, they are not getting basic amenities.

Q: I sold my house on 31st July(registered on the same date),and received the cheque on the same day which was cleared on 3rd August. Before the sale deed was done it was agreed verbally that i will vacate the house within 25 days after the cheque is realised. However, the purchaser now wants me to vacate ASAP. Q: We r getting a feeling of being cheated by this brand. . It was assured tht cemetery besides d compound wall of this proj will be shifted soon while booking a flat. But we observed yday tht it has been reconstructed now n still functional. It is going to b a serious health issue(especially 4 kids) as ash n smoke of flames will directly go in all d flats of nearby wings. Worst part is after sales service people couldnt able to address this concern and asked us to wait till thursday ie.16th aug to meet mr. Sunny regarding d same. Yes, i am agree with Anup. Do not believe in words only ask for the legal documents before buying property in any part of the country. It is a common practice now-a-days to make the innocent buyers fool and once you trapped, you will have to wait for long years to get the said amenities. Now, there is only one way, talk politely with the builder and try to resolve the issue. There is no other way left. It only depends on builder.

In absence of RERA approval, a project consider as illegal and few basic amenities will be stopped by the local body. RERA does not apply on completed project. No, being a resident of Wakad, I would suggest you go for Pimple Saudagar. It is a far better livable place than Wakad. Flats in Pimple Saudagar relatively higher side than Wakad. It depends on your necessities and proximity to the workplace. If you are a frequent traveler and travel too often to Mumbai, you can go with Wakad. The locality is well connected to Shivaji Nagar, Nasik Phata, Hinjewadi IT Park, and Mumbai Bypass. The rental market is also on the higher side. You can give your property on rent and earn a better return on your investment in the coming days.
I disagree with Anup. Wakad and Pimple Saudagar both are the good locations for the living. Wakad has almost reached its saturation point and prices are on the higher side as compared to Pimple Saudagar too. The average property rate in Wakad is Rs 6450 per sqft.while in Pimple Saudagar, average property rates in Pimple Saudagar is Rs.7000 per sqft. And the most important points is that Pimple Saudagar is close to Baner and Aundh has a good growth potential.

I agreed with Hamsika Iyer. Unlike the real estate law, which is gradually gaining ground and most homebuyers today are aware of their rights, most tenants are not aware of the state-specific tenant protection law. Q: Dear all, I just got a glimpse of a near completion property in the Godrej Prana, Undri project. One thing which concerns me is the fire hydrant pipes which run through the rooms (they are painted in bright red color and looks awful) . When I booked a property in the project they did not mention anything about the exposed fire hydrant pipes and also the show flat had only the sprinklers (all fire hydrants were concealed). Now the builder says as per the Maharashtra Fire Safety norms they would have to be left exposed that too in bright red color. I have visited many other properties in Pune. Most of them it's concealed though in some cases it's exposed.However I am assuming it's purely a cost based decision and is highlighted as part of project features . Now I have two queries: Q 1. Is there a rule which prohibits the builder from covering the hydrants? Q2. Also since the final product (flat) is different from what was described and agreed can this amount to deficiency in service/quality and a complaint be filed against the builder? It sinks my heart when I imagine those red colored pipe running in my bed room. Considering the price they are charging for Prana is it a too big thing to cover the fire hydrant pipes.

It is illegal. Fire hydrants shall be located and or protected from possible mechanical damage. The means of protection shall be arranged in such a manner which will not interfere with the connection to, operation of, and the maintenance of hydrants. Q: I have booked a property, however the possession date of that property is different in both sale agreement and rera. For ex: as per agreement dec 2021 and as per rera website dec 2023 Builder is saying he will deliver it as per agreement date. Can i trust him, will he deliver it as per agreement date and if not can i complain and claim for compensation.

You will get the compensation as per the possession date mentioned with RERA i.e 2023. If builder is unable to provide you possession within that date, you are liable to get compensation. Secondly, a builder can not mislead you as they have mentioned the possession date 2023 on RERA website. It means they will only provide you possession in 2023. Runwal Spacio is a newly launched project by Runwal Developers situated at Ravet in Pune. This project is spread across 1.52 acres of land parcel, offering 2 and 3 BHK apartments ranging from 739 sq.ft (carpet area) in 2 BHK, and 905 sq.ft (carpet area) in 3 BHK. Its current asking rate is Rs.8119 per sq.ft. A 2 BHK flat will cost you Rs.60 lakh onward while for a 3 BHK flat, one has to pay Rs 73 lakh onward. Is Runwal Spacio approved by RERA? Which local body and banks have approved this project?
Yes, Runwal Spacio is a RERA approved project and its RERA registration number is P52100019467. As far as local body is concerned, PCMC has approved and banks such as HDFC is funding it.
