13-storey building construction banned by HC in Marine Drive
The Bombay high court has restricted developer Vasant Sagar Properties Pvt. Ltd from carrying out any construction work beyond five floors.
The builder had proposed to build a 13-storey residential building in Marine Drive, which violates the height limit of 28 meters.
However, the builder said that all rules were being followed for construction and they had obtained all necessary permissions.
The Federation of Churchgate Residents filed a petition in the court challenging the sanction for the building. It argued that the developer had started construction without obtaining no objection certificate (NOC) from the Mumbai Heritage Conservation Committee.
Milind Sathe, counsel for Vasant Sagar Properties, pointed out that the then commissioner of BrihanMumbai Municipal Corporation (BMC) said no NOC from the heritage committee was required for carrying out the construction. However, he failed to convince the judges.
